On Sunday afternoon, Gutierrez and McCaullara apparently bumped into each other outside the James Farly Post Office on busy Eighth Avenue near 33rd Street. McCaulla wrote, "I turned around cause we bumped into each other we started talking like watch where you goin and we could fight." The rambling note maintains that McCaulla did not intend to kill him, just "stop the threat." Surveillance video shows Gutierrez ripping off his coat and assuming a fighting posture, and then McCaulla lunging at four times with a knife, killing him.
Gutierrez's sister tells the Post there is "no excuse for what [McCaulla] did. He could have just fought him like a man. Why would you take a knife and stab somebody in the chest three times? And he has a daughter, which makes it even more sad." Indeed, McCaulla was on his way to see his daughter (the note ends with "Sweetie I Love You Live For Daddy Cause I Can See Now Your Stronger Than you ever I ever would be"). Still, Gutierrez's mother told the Times, “I send my condolences to his family — I wouldn’t wish the way I feel today on any mother in this world."
The 28-year-old, who had served in the Army in Kuwait, had recently passed the FDNY exam and was on the waiting list for a job. (He was fired from FedEx two years ago for being in possession of stolen property.) But in his suicide note, he wrote, "If its hard for me to find work out of the army its gonna be 10 times harder if I come out as a felon." An uncle said, "We are suffering now. I just hope that people learn how to get along better in this world.”

I had to read this about 5 times to figure out what the hell was going on due to how poorly written (and edited) it is.
The guy was a piece of shit. It sure makes the taxpayers happy that this crapolla dude did himself in.
But he still served his country. What have you done?
Sorry, I don't buy this "served his country" nonsense anymore. Just because someone was in the military doesn't mean he automatically contributed to society. He may have had no other prospects in life. Thanks to the totally unnecessary war in Iraq stretching our forces too thin, the Army lowered its recruitment standards, even allowing people with criminal records to enlist. Would you excuse the soldiers at Abu Ghraib by saying they served their country?

What do you know. I paid my taxes last year. Those dollars served the country to pay for a war that is going nowhere except getting more unfortunates on both sides killed.

It's statements like this that make me think that this whole situation could have been avoided if not for Gutierrez's actions and mentality. Maybe Gutierrez should "have just WALKED AWAY like a man."
They both should have. However, I don't think multiple stabbings is the standard reaction to seeing someone raise their fists.
True, but who knows what Gutierrez would've done after the fight started. (Even though he was unarmed) Both of them escalated shit, but hey, they were just trying to keep it real.

I agree, but fear, if he really felt it, can make you react in ways you might not expect possible. Escalation is a great form of defense. He was trained by a Army that preaches overwheleming force as a tactical and strategic principle.

McCaulla's actions are totally wrong, but we cannot ignore that Gutierrez's actions are also wrong. If I bumped into someone, I would say "excuse me" and keep on walking. What was the reason for a fight to even start??? "Fight like a man"???? over what???? A simple shoulder bump?
There is too much damn aggression in this world. Just say "excuse me" and move along. People make me sick.

Thank you for your comment and thank you for being just a bit more openminded by seeing it could have been avoided on both ends...not speaking on anyone else's behalf just my own. I knew Sir'mone personally and he has always been one to avoid confrontation and squash drama. Everything in the media has been giving the public a false sense of who he was as a man, soldier, father and son. The negative comments does nothing to heal either family instead these comment only serve to fuel more pain, anger, disappointment and even bitterness on all sides. The 2 men have children that will one day look to old accounts of their fathers deaths...these should not be the type of comments they have to deal with in their quest to understand why they had to grow up fatherless. Think before you post. Please.
The most disturbing thing about this story is that the FDNY is even considering hiring people with a criminal record!

background checks/drug test/psychological tests, etc. are not conducted till after the persons name is called from the list.
Right. Wouldn't make much sense to spend the money and time checking backgrounds before people take the test.
The test is the first major step in weeding out applicants. Just about anyone can take it. But just as with the NYPD the majority of people who pass it and are "on the list" won't make it all the way to being hired.
I'd rather die of smoke inhalation and get burnt to a frazzle than have a firefighter with a criminal record save me.

I'm with you. No matter how wrong either of these men were, they're both dead now, and it doesn't make us any better than either of them to applaud their deaths as "two crazy guys off the street". Especially when those crazy guys had families who didn't view them that way at all.

Yeah, that whole "fight like a man" way of thinking is troubling. It's that type of ghetto mentality that often leads to death. Normal people can take these types of things in stride, but impulsive ghetto types will kill and/or die over it. It's almost as if there's a complete inability to reason and their lives are ruled by impulse, which is pretty disturbing.

the sister's comment is unfortunate, but understandable. OF COURSE one/both should have chosen to walk away, but as long as they were fixing to knucklechuck (agreed, BAD DECISION) it should have been on equal footing. the other guy doesn't even get off a stroke and he's stabbed mult. times?? i think the sister's thinking is that if a fight was a forgone conclusion, it should have been fists to fists and left at that.
Another sad example of how this country fails its veterans who come home from war traumatized and suffering from PTSD and other mental illnesses. Many of them are walking time bombs who self-destruct but not before destroying a few other people along the way.

Not that there's any way to really tell, but getting into fights with military dudes who have been combat deployed is usually bad news.
I heard one guy describe it on NPR once. He said something to the effect of "when regular people fight, they throw punches. I look to open up an artery."

This story is indeed very sad and disturbing but its nothing like the media makes it out to be. Please remember that the media uses false information to fill in empty gaps of a story. We have 2 unneccessary deaths of 2 young men that leave to mourn a lot of friends and family, especially the both of them have small children. Some of you people need to be a little more sensitive.
This is a tragic story.
Perhaps this is a story about the kind of health care that Veterans receive? Just a thought.

that included the nytimes article link for the hundreds of iraq/afgan verterans that have commited murders, great article with details and pictures. or the washington post article showing the alarmingly high rates of suicide, both in the war zone and back home.
what do you guys think is going to happen when thousands of these guys with loose screws return to our streets without a job, home or a mental health safety net.

Sounds like Gutierrez pulled his meat-for-brains ghetto tough guy shit on the wrong dude. Oh well. One less mad-doggin', knuckle-draggin' "gangsta" loser to deal with. As for McCaullara, this is sad. He sounds like a well-raised kid who truly wanted a decent life but badly needed a break (and maybe some therapy.)
