St. John's Student Threatens "VA Tech Shit" in Facebook Status

2009_09_stjohn2.jpg A St. John's student was arrested after threatening to "do some Virginia Tech shit" as his Facebook status. Radames Santiago, an 18-year-old from Washington Heights, posted the vague threat on Monday and then followed up the next day with a status that he “knows he will do it. You know I will, and to make sure that people watch CNN or something every day after” he kills everyone. Instead of tuning in, "friends" of Santiago dialed up St. John's officials, who informed police. Santiago justified "what he was doing" by giving the same reasons that many people leave a Facebook status that causes their friends to banish them to their hidden lists—he told cops that he was drunk and depressed "about everything" when he left them. Now that's a status that may have gotten some Likes. Instead Santiago could now face up to 7 years in prison. Queens DA Richard Brown said, “If a defendant posts a threat on a social networking site it will be treated seriously and investigated thoroughly." Two years ago, the campus was locked down when a student brought a rifle to campus; he was apparently schizophrenic.

thats LEGALLY required no registration.
a breech loading rifle where the solid gunpower loadis inserted in addition to a solid bullet.
these weapons are single shot and require manual re-loading.

Legally it was NOT a firearm.
Legally it did not require registration.
It is LEGAL to OWN in NYC.

I hope you were half-cocked before you inserted this primer.

Clarification: while it's correct that NY Penal Law in section 265 specifies that weapons like a musket are not firearms, that's only true if they're unloaded. Once you load it, it no longer meets the state's definition of "antique firearm."

NY Penal Law 265.00(14) [emphasis added]
Any unloaded muzzle loading pistol or revolver with a matchlock, flintlock, percussion cap, or similar type of ignition system, or a pistol or revolver which uses fixed cartridges which are no longer available in the ordinary channels of commercial trade.

It's further specified later in that section that certain regulations depend on the definition of antique firearm specified in 18 U.S.C. 921 (a)(16); generally the intent there is to prevent modern weapons from meeting the exception by allowing muzzle loading, either as manufactured or after modification.

Write something silly on Facebook and your "FRIENDS"
call the cops, instead of making a phone call or shooting you a quick email turning themselves into a civilian population as defined by the law.

if his profile was private then his 'friends' are bigger butt munchers. it is also possible that someone else could have written this, thats a good defense since IP logs would only show that his computer was connected not that he typed it.


thats all subject to interpretation, it will depend on his statements, if he kept his mouth shut a legal eagle could drive a train through all the holes in the charge.

you should all be concerned about this seeing that most commenters just spout their mouth off without any way of editing or deleting your Gothamist quotes and in no way should a single internet comment be epoused as meaning
