Whoa: The Hofstra student who claimed five men had gang raped her in a dormitory bathroom stall—resulting in four suspects being arrested and a manhunt for the fifth—apparently lied about the story. Newsday reports, "After hearing the news, prosecutors convened a late night court hearing at First District Court in Hempstead where Judge Robert Bruno signed an order dismissing the charges against the four men in the case."
Yesterday, the Nassau County police revealed harrowing details of the alleged rape—that the 18-year-old was lured from an on-campus party because one man had stolen her cell phone and lured her to a dorm where he and his friends tied her up in a bathroom stall and assaulted her. Nassau County DA Kathleen Rice said, "The alleged victim of the sexual assault admitted that the encounter that took place early Sunday morning was consensual. I have launched an immediate criminal investigation into the statements and reports given by the woman in connection with this incident." The student has been identified as Danmell Ndonye.
The four men— Bronx residents Rondell Bedward, 21, Stalin Felipe, 19, and Jesus L. Ortiz, 19, and Brentwood resident Kevin R. Taveras—had been all charged with five counts of first-degree rape and were being held on $350,000 bail each. Newsday has a photograph of the four men looking very relieved after being released.
Felipe spoke to WCBS 2 after his release:
"I'm actually very happy that the truth finally came out. I'm blessed. My family is here right now to pick us up and I'd just like to thank everybody for your support out there. The truth is finally out. I prayed to God on the inside that everything would work out. I actually thought everything was going to go down bad. It feels so horrible when you are innocent and then you are going down like you are guilty."Basically I have no hard feelings toward her. I don't know why she did it. I don't know her so I don't want to say anything bad about her. I grew up in an all-women household. I have sisters. All my women are aunts. I respect women. I would never disrespect women, so being accused of that hurt me and my brother, you know? I'm just happy that everything is finally out in the open and we get to go home."
On the Hofstra website, the administration writes, "To Members of the Hofstra Community, We have been notified by the Nassau County District Attorney’s Office that the young woman involved in the alleged rape incident has recanted her claims against the five young men. This week has been a very difficult one for our entire community, and we will need time to heal and understand the events of the last few days. As additional information becomes available we will post it on the University home page."

Story sounded a little funky from the start. I held off on joining the comment gangbang, as it was early in the case. But now that the young men have had their names, info and pictures plastered all over the media, and the previously alleged "victim" has been revealed as a reporter of a most heinous crime which never occured, may we have her name, info and picture? The former "victim" deserves to have the same exposure as those that were accused, and the rest of society warned to watch themselves around her. She also needs to apologize to those arrested, and offer an explanation to the media of her actions.

It's really incredible how often you hear about false rape charges. I knew someone in college who had his underwear take by police in an evidence bag because some girl at a party accused him of rape. And there was NO WAY he could have done it because he was with us the whole night. She recanted a week later but not before his parents hired a lawyer and he spent two days in a precinct being questioned and fingerprinted.

Turns out one of the guys took cell phone video of the gang bang which provided enough evidence of consent.
They took the video to their lawyers and they were cleared. Only after she found out about the video she admitted she lied.

No you wouldn't. Because if you were a lawyer, you'd realize that there's no question that the circumstances of the arrests clearly met probable cause requirements and were made in good faith, and that you'd have no chance of winning a suit against the police or the county.

I had this happen to me by a scorned x girlfriend of mine. It changed my life forever. We were on the outs, she was abusive, crazed. I was slashed on my left cheek during a psychotic fight we had while we were living together. She begged me not to leave her after that and apologized. I left before she woke up in the morning with my things and our animals we had gotten together and luckily I still had the lease on my old apartment for the next 3 months. We didn't speak for 2 weeks. Then I wake up one Friday morning to weird voice mail's from cops saying I had beat someone up the night before and they needed to speak with me. And other voice mails of how they were going to bash my door in and come get me etc, meanwhile I stayed at a friends house that night. My x then proceeds to call me and ask for us to meet up and talk, and I can walk her to her orthodontist appointment. I am in a suit sitting outside her job enjoying a nice iced coffee from starbucks when two men in plain clothing run across the street smack my coffee out of my hand, spin me around and slam me up against a fence. After a couple kidney shots to my back they cuffed me and threw me in a unmarked squad car and drove me back to Queens (where my X and I had been living) to charge me with rape, sodomy, and extortion! The girl even said I sodomized her. So after I stopped crying, yes I was crying and in complete shock, I was able to speak to these terrible detectives who had me locked up in a freezing interrogation room which was labeled the "ice box" I later learned. Then different detectives took turns coming in and screaming at me, saying if that was their daughter they would kill me, pushing me around, calling me scum, names, etc. This was the most traumatizing thing that has ever happened in my life. So after all that I wrote my statement denying everything they send me to the tombs of Queens court house where I spent nearly 3 days with no sleep or food. Who wants to eat peanut butter on potato bread?? I think I may have had an apple. Then I see a judge who at first wants 150,000 bail!! After I read my statement he dropped it down to 5,000. I had a family member post bail that day. Now I was arrested 4pm on a Friday, I didn't get out of jail, yes jail, they shipped me to "The Boat" a prison barge. Where I didn't get out until Tuesday 2am. They released me on bail with a 4$ metro card and had to come back at 8am in order to get my keys to my apartment or wallet or anything!! Here I am in a suit, 4$ metro card in a bad area of the bronx!!! WE went to court on and off for months just to have them drop the whole case due to insufficient evidence, no rape kit, nothing!! Just her word. I lost days of my life and am mentally scarred for life all for what? A scorned lover. I never really spoke about it out in the open like this, but when I say this article I cried a little when I read the kids statement. I would never do that to a woman, I was raised by women! That's it, I'm done. There's so much more, but now I am beginning to feel like I am writing an article. Oh, and nothing happened to my X, no false police report nothing.

In my student days in the 60's at the U of C, gangbangs, albeit consensual, were simply not tolerated. A classmate who organized one was promptly expelled. Universities, even those in Hoftra's league, need basic rules of student decorum. Or does this make me a bit old-fashioned?

But, far from a matter of decorum, the 5 former-accused were being judged for their morality. I read at least 1 Newsday article which stated as much. This incenses me. First, I have a disagreement with the way in which sex is perceived in America. Second, people are hypocritical, to the extent that, given the right opportunity, they would be all too willing to engage in the same activity.
The only laws applicable to this situation are the rape laws of NYS. Was it consensual? Yes. Were they all consenting adults? Yes. Case closed.
