Madoff: Brilliance Not Necessary When Lying To SEC

2009_08_madoffcancer.jpg For your listening pleasure: The Massachusetts Secretary of State's office released audio (after the jump) of Bernard Madoff telling hedge fund Fairfield Greenwich chief risk officer Amit Vijayvergiya in 2005 how to deal with the SEC when they might come snooping around, "You know, you don't have to be too brilliant with these guys, because you don't have to be." First rule of Bernie's Ponzi Club: You do not know about the Ponzi Club. Madoff said Fairfield Greenwich shouldn't worry about how he operated, "You don't want to have that information because ... the commission, when they ask questions, they try and draw out information. The less that you know how we execute ... the better you are." He recommended saying that since he's been around for 45 years, he's essentially totally trustworthy! Madoff added, "They ask you a zillion different questions and we look at them sometimes and we laugh, and we say, 'Are you guys writing a book?'" And he says of needing to deal with another phone call, "I'm sorry. If I get any more solicitations for charity, I'm going to kill myself."

It was probably a rule of thumb in the investment business that any inspection by a gov't agency is not to be feared. The investigators will realize there's no future and will soon be looking for jobs on Wall Street.

This is why I agree with Ron Paul when he says to get rid of the SEC.

Q. Well, then who will regulate the investment firms?
A. Nobody is regulating it right now. Who cares whether the SEC is there or not?

What the heck is a "Chinese wall"? Are they like the Floridian cheap-o Chinese dry walls that crumbled and smelled like shit?

Yes, the Chinese Wall is a figure of speech whereby certain parts of a firm doesn't share information with other parts of the firm that might show any sharing of information that might compromise the integrity of their investor's interests.

Right. Every firm abides by that. Right . . .

The SEC is kinda like the TSA... it's security theatre.

Sadly the FCC is going that route these days too... I mean they let GSM into the field and it's operating on audible frequencies... what the hell sort of incompetence is that?
