No. As the article says, there's a separate minimum wage for food service workers who also get tips. Currently it's $4.60 per hour for waiters and waitresses who earn at least $2.55 per hour. There are also a number of other minimum wage levels established for other service industry workers through what's known as a "Wage Order."
Again as the article says, he was getting tips, so he wasn't living on that low reported wage amount alone. But he's still now maintaining that whether he was able to get by on what he received or not, it should have been more.
The tips must have been good for him not to complain but when the economy tanked, out came the pay stubs.
