Judge: Anonymous "Skank" Blogger Must Be Revealed

A former Australian Vogue cover model, whose modeling career ended last year after a doorman disfigured her face with a broken bottle, has obtained a court order to learn the identity of an anonymous blogger who created a site called "Skanks in NYC" to insult her. The site, which was hosted by Google subsidiary Blogger.com, featured photos of Liskula Cohen with captions using the words "skank," "ho" and "whoring." (It's no longer active, but Blogger says "the name skanksnyc is available to register!") A Manhattan judge ruled yesterday that Cohen is entitled to file a defamation lawsuit, and Google must reveal the blogger's identity in order for her to do so. Speaking to the Post, Cohen's lawyer said something that might give some website commenter trolls pause: "The rules for defamation on the Web—for actual reality as well as virtual reality—are the same. The Internet is not a free-for-all." But a lawyer for the Skanks in NYC blogger insists, "You can be really, really mean to people—you just can't lie about a set of facts that are provable as lies." As for Cohen, she tells the Post, "I really hope it's not somebody I know."

    Freedom of expression is a contradictory term as there is always a cost. Unfortunately, internet smear campaigns & assaults are a negative off-shoot of free speech privileges. The concept of freedom of expression requires a better peek, it is not actually free; it comes at an extraordinarily great price. The price must never be paid by a clean-handed person or business.


    But, artificial assertions & libelous nasty grams are regularly posted by anonymous bad guys. They have an insatiable compulsion to hurt or control others; they are actually driven by the suffering of others; the victim's futile pleadings is what fuels them, or "narcissistic supply". Normal people such as 97% of those reading this account cannot begin to envisage what makes these people tick. I challenge you to stop for a moment, try to imagine having no conscience; it is plainly inconceivable.


    This distressing social conundrum has grown in the last ten years due to unchecked anonymous cyber slander. In cases where courts have ordered that anonymous forum posters should be revealed to the libel victim, such directives are often a cause of outrage for a trivial but noisy collection of zealous people that suggest that freedom of expression deserves to be absolute and that a utterer can't be held to account for his/her words, without regard to the truth or falsity of the statements. I assume that should these same protesting people could live through the debilitating consequences that a relentless internet enabled sociopath causes to the physical, vocational, emotional, and social health of targets or their family; they wouldn't be as zealous in their opposition.


    An underlying weakness of publishing anonymously is that credibility is reduced if seriously assessed by intelligent and objective folk. Despite this fact, there is a newfangled dynamic with the quandary of vindictive and anonymous internet authors. Although vitriol may smell of shenanigans, when the target is being "Googled" for employment, contract awards, Boy Scout leadership or dating, the person conducting the due diligence needs to consider the likely PR exposure from engaging the target. Although the potential employer can probably see through the denunciation, the decision maker will probably be cautious about what their customers and partners will imagine if they are not as clever and open minded.

    Its quite possible the person who started the blog is the misogynist who cut her face (and who has attacked other women in bars as well). These women-haters with anger-issues never ever let anything go. The 30 days he had to serve for ruining her career probably serve to justify the website from his twisted perspective.

    Well, this lawsuit guarantees one thing: far more people will now associate this woman's name with the word skank than would have otherwise.

    One could argue that "skank" and "ho" have become generic insults and in most instances are not allegations that a woman is actually a hooker. It's like calling a man a mother******. The word's literal meaning is not intended.

    It's a reasonable guess that the chances are about 100% that it is someone she knows. A person who doesn't know her wouldn't bother,
