- During one of their three trips to the woman's apartment (caught on tape), the officers allegedly stole her Blackberry.
- In the days after the alleged assault, Moreno and Mata are accused of getting in touch with the woman's mother and brother as they were "trying to intimidate" the woman. It was around this time the woman met with Moreno and secretly taped him apologizing to her and admitting that he wore a condom during the sex, which he has claimed was consensual.
- The woman was out with friends at the Park Slope club Southpaw for two hours before the cab ride home to her East Village apartment in which the taxi driver would call police because she was too drunk to get out of his car.
- The woman is described as "a high-level executive at a well-known company."
- The claim also states that "other specific facts" about the incident would come to light if the city does not compensate her and she proceeds with a lawsuit.
The two officers are due back in court September 16th. A lawyer for the woman told the Post, "The notice of claim speaks for itself. We are continuing to cooperate with the ongoing criminal investigation."

Apologizing for consensual sex? Yeah, that makes perfect sense.
What these cops did is terrible & disgusting & there is no excuse for it, but the woman would have done well to not be such a drunken imbecile.
Sure it's not a good idea to get so wasted you pass out in a cab. In fact in other situations I have expressed a distinct lack of sympathy for the rape victim. But in this case it was the COPS who raped her. The cabbie specifically got her help when she had got herself into trouble, and the men who were supposed to take care of her raped and robber her instead.
what's the nypd policy on this? take her to the hospital, the drunk tank? Leave her there? isn't there liabilities when entering a private resident/establishment therefore strict policy guidelines on such.
why did they have to mention that she's a high level exec at a high profile company? to make me more jealous and bitter?
"It's so terrible, but give me some money and everything will be okay again"
The second I hear someone is suing my sympathy goes to zero.
Really? So if cops entered your home and sodomized you while you were in a drunken stupor, you would just write a nasty letter, yeah? Sorry, but the lawsuit is entirely appropriate. Is your lawsuit/sympathy ratio a general rule? So the parents whose baby's face is mauled off by a neighbor's unchained and vicious dog are deserving of your sympathy only up to the point where they don't seek damages relating to the mauling? That's pretty retarded.
The parents should be reimbursed for the cost of the medical bills for the damages. Punitive damages are stupid.
People are raped all the time. Why does she all of a sudden deserve $5 million? Did she miss $5 million in wages when she missed work?
This just follows from Americans who largely believe they will end up rich via the lotto or a big lawsuit.
Lawsuits should be used to reimburse the person who took a financial loss. She didn't lose $5 million, she should fuck off.
Who said "everything will be ok again"? The point of taking money is not just to take money, but also to serve as a warning to others: if you commit a crime, or allow someone whom you are responsible for to do it, it will cost you.
I am all for suing the living crap out of everyone you can. No one understands they did something wrong until you hit them where it hurts them the most: in their wallets.
Bullshit to both of you.
Tell me right now how much money I could pay you to rape and murder your mother or daughter. That's how much your logic works to me.
There are values above dollars even if neither of you recognize them. And I'm not talking religion, just fucking values.
To take a payout on behalf of a tragic like that is to put yourself on the same level of the perpetrator of said tragedy.
It's too bad that lawsuit happy scumbags and the assholes that fuck up enough to legally warrant a lawsuit exist.
She should sue for 10 million. And they should get their jobs, pensions taken away and be put in jail for a long long time.
Yes that makes sense, except in the world of the NYPD, in which it's nearly impossible to lose one's pension even when you do something stupid enough to cost the agency $5 million.
I hate pigs.
Huh? Those two clowns didn't cost the *agency* $5M, they cost the TAXPAYERS $5M.
I doubt this was the first time those crooked cops did something illegal. Both of those idiots are from the Ninth Precinct. Maybe some changes need to be made at that precinct.
These have got to be two of the dumbest cops in NYPD. And that's saying something.
Yes, but note that the post said "the city and both cops". These POSs will be "indemnified", the city will have to pay for their personal actions while on duty, they will likely (if enough time on) keep their pension and bennies, then become Sanit/FDNY/Dept of Ed, or maybe Nassau/Suffolk/TBTA cops. The real thing would be to sue these dumbasses, and make them and their families keep paying for the rest of their lives. They did the crime, something they would have shot a guy for had they done it to their wife/sister/daughter. Let them pay for it.
Exactly- these PEOPLE should be penalized in some way...money for the family s not right...nor is penalizing us taxpayers. It's these people. Assholes are assholes- they shouldn't be allowed to have a badge of protection.
...to serve and protect...
Here's to hoping these scumbags die poor, cold, and hungry.
