City Tickets 10-Year-Old For Having a Lemonade Stand

2009_08_lemonade.jpg As if Parks Commissioner Adrian Benepe hasn't been given enough agita by the New York Post this summer as they breathe down his neck over delinquent lifeguards, now he has to answer why his officers are giving out $200 tickets to a 10-year-old girl selling lemonade at Riverside Park. 10-year-old Clementine Lee and her dad Richard set up a stand selling lemonade for fifty cents a cup yesterday afternoon when they had their run in with Parks officials. Richard Lee describes, "They approached us nonchalantly but then surrounded us. They were very hostile as soon as they approached, saying 'Where's your permit? Where's your permit?' " The Parks party poopers issued a summons that carries a fine of up to $200. Benepe waved off the ticket, saying the officers used poor judgments and would be retrained. He tried to save face by telling the paper, "We're going to make lemonade out of lemons...I look forward to buying lemonade from her if I pass by." But if you think the commish can out-adorable young Clementine, guess again. The "soccer enthusiast" says she was "really nervous" when she and her dad were cornered and added, "It was such a hot day I figured people would want a cold drink."

    I see three black cops and a little girl with her dad who lived across the street selling lemonaide and cookies. Why can't the behavior of the cops be called racist? If it were the other way around, you bet it would be. Al Sharpton would be demanding a cup of lemonaide at the White House, and he would get it.

    BTW, the ticket was only $50.00, and then dismissed.

    Still, the race thing is something to think about. I'm sick of reverse racism and people ignoring it because it's against white folks.

    How about fining all the dumb ass motorist, and bikers, (I am both) who break the laws daily - i.e - riding down the street the wrong way - ignoring street lights and signs, etc. Like the ones that rode over two ten year olds on my block! Ticketing them seems dumb and mean. Someone has a chip on their shoulder. I doubt the world would start selling lemonade in the park because two children were doing this.. dumb..

    maybe ticketing wasn't the smartest of ideas but the officer was following the rules. you set a precedent for one thing and that precedent will lead to others.



    so now if a grown adult sells lemonade illegally, he can always refer back to this story.



    if the officer just warned them not to do it again and told them to pack up and leave, all would of been ok in the island of manahatta.



    besides using the excuse "it was a hot day ... i thought people could use a cold drink" is dumb b/c you're charging them money. if you really thought people needed a cold drink, you would of given it away for free.

    Honestly the 2G1C video never entered my mind when I first saw that picture, and It probably wouldn't have clicked if you and some other overly anal readers didn't bring it to our attention.



    And now some readers who have no idea what the phrase means will look it up online and their Monday will forever be ruined.



    And to be fair, there are two girls sharing one cup (ok and one pitcher). Gothamist is simply stating the facts.

    It's the camel's nose under the tent flap thing. Kid & Dad were likely asked to stop, didn't, got tagged. My kids have asked about the same thing, told them the regs & drawbacks. If this case gets by, I'll be getting a water dog wagon, setting up outside the Metropolitan, and sit back in a chaise while my kids run the wagon, fee-free. You want a 5 dollar pretzel, a salmonella knockwurst? Talk to the kids under the umbrella, I just hold the cash. I feel for the kid in this story, but Dad should have known better. Did she have a food handler's course certificate posted? Was she paying sales tax? I can see setting up in your front yard, but a City Park? Good lesson in civics, business, government for Kid & Dad. And if stuff like this isn't (even with a warning) enforced, Central Park will look like the walk to Kukulcan in Chichen Itza. Kids vending, parents supervising, next thing ya know it's Three Card Monty run by 8 year-olds.

    In your own front yard..sure, go ahead and sell all the lemonade you want. In a city park...just pay the fine and STFU.

    The cops weren't totally wrong, although I think a warning would have been appropriate.

    Pretty stupid to give a $200 ticket to a kid and her father selling some lemonade for only $.50 a cup....Then again, unless I was in a bar or restaraunt, I wouldn't buy a cold drink from a complete stranger on the street... Unless it came in a factory sealed can or bottle

    The situation obviously warrants a warning not a 200 dollar ticket. And it only needs one officer, not a pack. It's a ten year old with a lemonade stand fer chrissakes. Granted its not in a park and can't stay, but it's about as far down the chain as a crime gets.

    Unless something is missing from this story, I don't agree that the officers used poor judgement. The kid wouldn't be expected to know any better, but her father should be aware that he needs a permit to set up a food stand in the park. Why should he be exempt from the law just because he had a kid with him?

    Doesn't this little girl realize that drink distribution on hot days is only for licensed individuals and corporations? Bloomberg and his grubby grasping minions need their cut otherwise no fucking way!



    Besides, fifty cents a cup? What is this girl, a communist? Lemonade in similar cups should at least fetch eight dollars (or thirty if you're at Citi Field or Yankee Stadium).

    PEPS, are they going to be downsized in this economy? We are paying their salaries while their sole purpose is to write tickets on spurious charges so Bloomberg can count it as "revenue" in his budget.

    The PEPs have been trained to exactly what the Parks Department wants them to do - harass park goers and make their ticket quota.
