Last night, a Connecticut advertising executive surrendered to the police after a frightening standoff in which he kidnapped his wife, demanded a priest come and give her last rites, and then asked for a judge to re-marry them. Around 8:30 p.m., Nancy Tyler managed to leave the South Windsor house that ex Richard Shenkman was supposed to turn over her as part of divorce settlement, but the Post reports, "Dozens of gunshots and explosions were then heard at the home, which was soon engulfed in flames." Shenkman, who had asked police to shoot him, finally gave up around midnight. He also made his demands through a reporter for the New London Day, who previously covered his wife and him, and seemed to confide in the reporter: "If I wanted to do a murder/suicide, I could have done it three years ago. I've never hurt her in my life. I do want Nancy to walk out of here. I don't trust the cops. They have screwed up so much in the arson (case) and all that stuff." Police are at the home today investigating whether the home really had all the 65 pounds of explosives Shenkman said it did. He will probably be charged with kidnapping, arson, and reckless endangerment.

Could this incident perhaps have been an unfortunate consequence of our totally pro-female divorce laws? Consider that the man was being forced to turn over the house to the soon-to-be ex-wife, even though he was apparently unemployed (his advertising business was no longer in operation) and 60 years old, while the wife was a lawyer at what seems like a fairly busy firm. If he were getting a better deal in the divorce he might not have snapped.
New York State divorce law recognizes what is called "equitable distribution" which, means that all property (excluding something extreme like educational debt from advanced degrees on part of one spouse or a small bussiness debt etc.) is divided equally. Women in NY do not recieve alimony (which, is something from a bygone era when women were not college educated). In fact, if he has been unemployed for say, six months, he will be recieveing half of whatever she has been earning during the final months of their marriage.
Usually the house goes on the market and the spouses spit the profit evenly. Commonly, one spouse may buy out the other spouses half of the property, essentially buying the home from them.
My guess is that, besides being wildly unstable, he was probably angry that, being unemployed and even though he will assume half of whatever she earned during the course of their marriage, he could not garuntee the future payments on mortgage to the bank. Especially, with banks cracking down on credit, they would never give an unemployed person a mortagage- therefore rendering him unable to buy the house from his wife.
Not quite. "Equitable" means "fair," not "equal." The law has a whole list of factors that a judge may consider when deciding how to divide up property. And as jutpskdiax says below, there certainly is alimony in New York. You may have meant to say that it's not automatic, which would be correct, at least in theory.

The notion that divorce doesnt favor women is total BS. Typically what happens is the women will have the man evicted from the house with a simple 'I feel threatened' restraining order. The man will still be ordered to pay for the house. The man will almost NEVER EVER get custody and will pay 20% for child support, plus college, plus child care, plus schooling. The man will probably pay for the house until the kid is 18.
Its totally unfair and any man who gets married is an idiot. its that simple.
