New York State's only openly gay Senator, Thomas Duane (D-Manhattan), is telling the media that if the Senate votes on a bill to legalize same-sex marriages, it will pass. Duane, who is the bill's primary sponsor, tells Newsday, "Already there are enough votes for it to pass and a cushion." But that view was hotly disputed by other Senators, including Majority Leader Malcolm Smith, who supports gay marriage but refuses to bring the bill to the floor before the legislative session ends on June 22nd unless it's clear there are enough votes to pass it. Smith insists, "I don't have 32 votes that I know of." Senator Frank Padavan (R-Queens) says Duane's "dreaming," and Senator Ruben Diaz Sr., a fierce opponent of same-sex marriage, slammed Duane's prediction, telling the Daily News "It's unprofessional to be playing with people's minds." Governor Paterson, who'll sign the bill if it reaches his desk, is urging the Senate leadership to put the bill to a floor vote, regardless of the vote count. But openly voting on such a divisive issue would take political backbone, so Duane can probably just keep dreaming.

Can we please show California that we are smarter? They put it to a popular referendum and it obviously failed. Imagine if civil rights for minorities (or freedom of the slaves) were put to a referendum back in the day. It would have failed back then too. The point of a Congress was that they'd act for the common good. Lincoln just came out and said, Slaves are free. That would have never passed a referedum. Good for him.
Here's hoping that the Senate realizes that everyone has rights, and takes a possible unpopular - but absoultely correct stand. The Gov should FORCE a vote...but I really hope this doesn't go to public referendum. I agreed with the CA court, but their hands were tied. The could not overturn a decision made by the people.

You'd think an enterprising person with something to sell (you know.. like a reporter working for a newspaper) would just call each senator's office and ask where they stand. Split it up between 3 or 4 reporters, and you could even get it done in an afternoon.
Doesn't work that way.
The undecided senators are undecided either because they're afraid of the consequences for coming on out either side before they're forced to vote or they're playing coy and waiting to be bought out by one side or the other. Not everyone has taken a strong stance one way or another so you have a lot of undecided votes and there are lobbyists on the ground working on those who have said they'd vote one way or another.
