City Settles For $2 Million In Death Of Neglected Patient

The city agreed to a $2 million settlement with the family of Esmin Green, a woman who died after being ignored in a waiting room at Kings County Hospital's psychiatric ward. Green had been waiting for almost a day last July until she received medical attention which came too late. Her decline—falling off the seating and writhing on the floor until she was lifeless— was captured on surveillance video, which showed a number of staffers ignore her; they only acted after another patient alerted them.

Green, who suffered from depression, had come to the United States to earn money for her family back in Jamaica. Her family had initially planned a $25 million lawsuit against the city and hospital; today, the family's lawyer Sanford Rubenstein said the settlement was "fair and reasonable," but added, "What remains most important to this family is the criminal culpability for those responsible for what happened and those who attempted to cover it up, which continues, after all this time, to remain under investigation by the New York City Department of Investigation." The cover-up Rubenstein refers to is how records stated Green was up and around when, based on the video, she was laying unconscious on the floor.

The head of the Health and Hospitals Corporation, which runs Kings Country Hospital, Alan Aviles said the settlement includes a "full apology and acceptance of HHC's responsibility for the events leading up to the tragic death of Ms. Green."

The city screws up and the people pay for it.

These are front line of care givers. She probably annoyed them at other times and they wanted to teach her a lesson. Instead she taught them. Only they have a chance to mend their ways. She doesn't.

When are the people responsible for this sort of thing going to become accountable? I know it's coming, but when?

These hospital employees can always get a job with the Access-A-Ride people.

I never understand the idea behind puntative damage against a city. Such award basically said that it is the fault of everyone in ny that the event occured.

The ppl responsible, in this case the hospital staff, should be responsible. We have enough tax in this city already.

The family should receive a settlement, but I resent having to pay for the negligence of these people.

Unfortunately, official misconduct or malfeasance by a government employee is covered by city/state risk management pools. It's an insurance issue that only tangentially affects the costs of government. In a perfect world, the individuals involved could be held personally liable for their negligence every time, but that usually only happens in cases of outright malice towards the victim.

Watching someone die while you're in one of the most ideal positions to help?

With the big outcry about subway operators not breaking up a rape last week....why aren't people upset about HOSPITAL WORKERS watching a woman DIE on the floor? That is their job and there was no danger...other than she might be 'annoying' them...she waited for more than a day!

It'll just get tacked onto the medical and tax bills of people who actually pay them.

I'm surprised the settlement was that high.
I usually see NYPD wrongful death suits settled for much less.

I think the family valued the apology from the hospital over the money.

There are a lot of happy people in a small village in Jamaica over this settlement.

Do you realize she would have to work many many hours scrubbing floors to send that kind of money back to her kin.

Cannot say this was not a tragedy but compared to the scenario associated with the incoming healthcare plan proposed by your erstwhile president, this is a preview of things to come only on a daily basis. Have you ever seen anything run by the government succeed? For those of you who are veterans think VA

It's easy to note government failures, but to say no successes is an outright lie. From an interstate highway system to landing men on the moon to creating a postal system that allowed millions of rural folks by what they needed (Sears&Roebuck was making a fortune before the malls)even you might concede some things did work out. And I'm not seeing any private firms building airports or running the subways around here.

Except that makes no sense. The people working at hospitals under a government healthcare system would be the same people working at hospitals now.

I dunno why you mentioned VA. The VA outranks private healthcare in customer satisfaction.
