Ratner Relieved After Court Dismisses Atlantic Yards Lawsuit

2009_05_netsbkl.jpg After a state appellate court rejected a lawsuit stopping his Atlantic Yards project, developer Bruce Ratner says that ground will be broken sometime this year (maybe this summer, maybe this fall). He told the NY Times, "I’m honestly overjoyed. This is a weight off my back." A group of property owners in the footprint of the massive project had claimed eminent domain was improperly used to obtain land; the appellate court unanimously rejected the challenge, finding, "It cannot be said that the public benefits which the Atlantic Yards project is expected to yield are incidental or pretextual in comparison to the benefit that will be bestowed upon the project’s private developer." Still, the opponents, who believe Ratner will profit much more than the public will benefit (and who have helped stall the plans for two years), vow to take their case to the Court of Appeals. The Daily News notes, "The decision allows Ratner to qualify for tax-free bonds to build the arena and the go-ahead to purchase the MTA-owned rail yard on which it will be built."

It's all one big pantomime for Ratner. No bank on earth would finance his idiotic scheme and yet he behaves like he just struck oil off Dubai.

Again, my hat is off to those Brooklynites who fought this project. Keep it up. Shame on ACORN, "Rev" Daughtry, and Dopey Markowitz for selling out Brooklyn. Walter O'Malley would be proud of these Quislings.

Another joke of a decision by a NYS court. The government shouldn't be allowed to continue using eminent domain to steal people's homes and businesses for private development. This is nanny-state corporatism at its worst.

If Ron Paul was President he would stop BS like this from happening. Instead of him we've got a neo-liberal global corporatist in the oval office, so I think this will become more common and the judges will get even more meddlesome.
