Parents Sue Parents, Car Owner Over Son's Death in DWI Crash

042709ogle.jpg The devastated parents of a Queens high school student who was killed by a drunk driver are suing the parents of his friend for serving booze at a party the night he died; they're also suing the motorist who left his Kia Spectra idling outside a convenience store, where an inebriated ex-con stole it. 16-year-old Robert Ogle (pictured) was walking home with his 20-year-old friend Alex Paul at 1:30 a.m. on February 1st when they were both struck and killed by Kenneth Guyear, who prosecutors say took off in the car after owner David Jaber left it unattended. The wrongful-death lawsuit contends that Sing-Chau Fung and Yuk Lai Fung are to blame for permitting underage drinking at their house that night during a birthday party for their son; Jaber and Guyear are also named in the suit. The teen's father, Brendan Ogle, tells the Daily News, "Each person in their own way contributed to this train wreck. If everyone had exercised better judgment, my son would be alive today."

    Rob was a good boy. We were really close. Went to school with him, played sports at juniper with him, he was a really good football player he thought i was so cool because im a girl and i knew how to throw a spiral. His family is a good family. His family just doesnt know how to handle it, so theyre trying to do anything they can. theyre looking for comfort. wouldnt you if youre 16 year old son was killed. You dont know how badly it hurts to lose a child unless you have. every day you see it in Roberts parents. Dont rag and degrate his parents and family because youre not in their shoes. You dont have a son who passed way too young. So be respectful. Its been a year and its still hard. And about the guy who killed Robert and Paul hes being sentenced Feb 23 max 15 years could be out in 7. Is that right 2 lives and only in jail for 7 years. Really?! so basically one life means 3 1/2 years to the law. so stop critizing the Ogles and think about the justices system because you could be killed by a drunk driver anyday and theyd only ge 3 1/2s for ending your life. RIP ROB its been exactly a year we miss you xoxo

    And the at the kids party it was in his basement and his parents were sleeping nd they were in the basement so they did not know what was happening. And dont say they should have been down there...When u were a teen would u have wanted ur parents in the middle of ur 17th bday party, i doubt that.

    I am one of robert ogles closest friends. Robert usually went home early. I was not with him that night but i saw him a few hours earlier. His parents would always be calling him at 9 to tell him to come home. His parents were the strictest out of all my friends. He never drank or anything so this was his first time. He was passed out and alex paul was carrying him. They were hit because alex could not get out of the way. As for his parents suing i dont agree but they were always strict about wat time he came home so it is ironic that he had to die late at night when his father always wanted to pick him up. His phone was dead and robert didnt tell him wear he was going because his father was overprotective. And it wasnt that bad that he was out that late because he was only 3 blocks away from his house. It was kenneth guyears fault and noone elses so i do not agree with everyone being sued. It will not bring robert back,

    That guy definitely does not deserve to be sued after his car was stolen, but seriously, who leaves their engine on while nobody's in the car? That's incredibly stupid, let alone that it wastes gas. Does it make him at all accountable for this kid's death? No. But I can't muster up too much sympathy for him.

    come on guys dont blame the victim here-

    there is a clear problem in this country

    with the dui laws-they need to be stricter

    and information needs to be relayed on tv and

    in schools when and if these laws pass- in countries

    where there is stricter laws the issue of drinking and

    driving is unheard of-- think of the person you love

    in this world and then imagine how you might feel if they

    died in a manner as this-

    The parents who served drinks to minors are idiots and criminals. But, it's not likely the victim could have saved himself from a speeding stolen car even if he was sober.

    This lawsuit in bringing justice for this unfortunate kid's death is all well and good... But you know, I don't think it goes far enough. In addition to suing the adults who held the party and the guy whose car was stolen, shouldn't they also be suing KIA, the alcohol companies that produced the beer that both the DWI suspect and kid drank, and the makers of the product that prompted the motorist to visit the store in the first place?

    Another sad example of what's wrong with America that could be fixed. Make these parents pay for the court costs, the defendant's time, and for contributing to the absurdly litigacious society we are unfortunate enough to live in.

    Don't make a spectacle out of the loss of your loved ones.

    The guy who left his car idling (double parked I bet too) is an idiot and deserves suing, even if the lawsuit is frivolous. Starting that car engine is so very time consuming.

    this is a terrible story. while i think its absurd for the parents to blame somebody else for their son's actions, i don't think any of us can understand what they are going through unless we have lost a child. sure they are grasping at straws, but it's really all they have left.

    They're suing the guy whose car was stolen???? How about the construction worker who paved the street the accident took place on? Or maybe the person who painted the lines in the street, or he guy who pumped the gas in the car? Maybe if a little girl leaves a jump rope in the street and someone uses that jump rope to strangle someone we should sue the girl's parents and the jump rope manufacturers.

    I disagree Toby, you have to be an IDIOT to leave your car idling in front of a store. If he hadn't, it's very possible this guy who stole his car may not have stolen someone else's. After all, who does that? I would say he deserved to get his car stolen, but of course, that led to this tragedy. But still. He should get sued.

    Agreed, if he had left his handgun idling on the sidewalk and a drunk (or not drunk) person picks it up and uses it...he would be responsible. Cars fall into the weapon category when they kill, endanger, injure, or pose a threat to people.

    The lovely parents should sue themselves for having their drunk teenager (who they knew was attending a party) wandering around NYC after midnight. Brendan Ogle should have exercised much better judgment as a parent.

    Until then, stop suing people to cover up your own parental failures.

    The suing the guy who had his car stolen just makes the dead kid's parents look like greedy scum trying to profit from tragedy.

    I agree. Any sympathy I had for them is gone. The poor guy had nothing to do with it. In fact he had his car stolen. Why should he be responsible for some drunk thug who took his property.

    Lawsuits are a persons only defense against the carefree, irresponsible fucking idiots of this world. Even if its a hopeless case, make them show-up and defend themselves. All because somebody's parents wanted to be thought of as "cool".
