Gillibrand Pushes To Dump Gun Amendment She Co-Wrote

2009_01_Gillyhl.jpg Senators Schumer and Gillibrand were in town yesterday asking President Obama to eliminate the Tiahrt Amendment, which requires the FBI to destroy records of gun buyer's background checks within 24 hours. Gillibrand had co-sponsored the law while she was in Congress and said, "In my previous district, we didn't have gang violence, and we didn't have the gun violence that we have throughout New York." Schumer supported her change in stance because he said that by representing all of New York, "You meet more people, you grow." But potential primary opponent Carolyn McCarthy still sounds unconvinced, telling the News, "I thought it was strange that she signed on, given she was one of the people who wrote that law." One Democratic operative added, "She could hurt your neck, watching her move."

HOW in the world did patterson pick her?? she's now has a wide range of views? how would someone not think that say places like NYC would different then 'cuse or rochester?

Don't give into Chucky, KGil. The 2nd Amendment has not been repealed with any other amendments, I believe.

It's a not a two-way street; you can't have it both ways when it suits your liberal talking points. Liberty knows no party.

Guns can be bad. Fast food can be bad, too. Let's start tracking those who eat shit. Spraypaint can be used for art, home repairs, or vandalism. Should we create a massive record system for those who buy it? What about knives like yg said? What about box cutters? They helped crash two planes into the WTC, so should we start to create an information stream on the arts and crafts crowd at Michael's?

My right to own a gun cannot be impeded by onerous regulation of "poor taxes." To do so impinges on my civil liberties. KGill---don't give in to Chucky and the libs.

Phone records isn't a bad analogy, actually.

In almost all situations, only you and the dealer have access to the information, for the purposes of completing the sale. It then goes into the FBI database.

If police have probable cause, they get a warrant specifically listing what they're looking for in the database. No browsing of the database would be allowed, no fishing for hits, data mining for patterns, etc.

Note that this change would extend the retention period from 24 hours to 90 days (which it was pre-2004, and it was 6 months in the 90s). In all cases, there is no permanent record.

(AFAICT, the Tiahrt amendment has nothing to do with background checks. It has to do with traces and access to the BATFE database by non-law enforcement persons.)

(I'm not defending the rationale of retaining these records. I don't know whether there is or isn't any meaningful purpose for doing so.)

The 2nd's intent was to allow gun ownership specifically for the overthrow of a central government that had outgrown it's mandate.

Like that would ever happen.
