Two Fire Island police officers have been acquitted of most of the charges against them stemming from a 2005 incident that left a tourist with a burst bladder. While the jury remains deadlocked on a lesser charge of third-degree assault, a misdemeanor with a maximum sentence of a year in jail, they have found Police Chief George Hesse and Officer Arnold Hardman not guilty of first-degree gang assault, as well as other charges. The two were accused of beating a drunken marketing exec named Sam Gilberd at the Ocean Beach police station after arresting him for littering. The beating allegedly occured after an irate Gilberd kicked the station door after he was initially released; he says the cops then pulled him back inside and beat him senseless. According to Newsday, the officers' lawyers may now try to get the other charge dismissed, but Gilberd's still proceeding with his civil lawsuit, seeking $22 million in damages.

Well that was kind of a stupid thing for him to have done, now, wasn't it? How 'bout this, the cops get reprimanded for what they did and and Gilberd serves time for being an asinine asshole?

There was no claim made by the police department that the door was damaged. In fact, they don't even say that he kicked it. They say that he fell inside the station.

Those are his allegations, not those of the police. The police officers are defendants in this case, hence allegations are made against them; he is a complainant. He alleges that after he kicked the door a cop dragged him inside and he was beaten. The police officers' defense is that none of that happened.
Umm okay, so Gilberd, ADMITS, CONFESSES, that he kicked the door. And you're saying that he didn't????
Reading comprehension issues continue. Nowhere did I say that he didn't, or that he did. I said that to do so would be stupid, but not illegal. Your response was that it would be illegal if he damaged the door, to which I replied that there has been no claim by anyone that the door was damaged.
Therefore, there is no claim by anyone that he committed a crime after having been picked up and charged with littering.
He admits he kicked the door, it could have been damaged, and I stand by what I said earlier:

I'm sure he deserved a good kick in the ass, but a burst bladder is taking it too far. The guy almost died and spent a long time in the hospital.
Oh yeah, and I stay the hell away from the No Beach police. You'd think working on a party island they'd have a higher tolerance for drunken assholes.

It all started because this drunken idiot (who admitted to having over 12 beers) threw a glass cup off a bar deck at onto the sidewalk below. The police station was a few steps away where he got a citation for littering. He left pissed off and then kicks the door of the station. The cops tried to bring him back into the station where he struggled. A bladder full of beer + fighting with police = some type of injury.
Take the damn ticket and be on your way (back to more drinking). It was his own fault.
