The police are asking for people's help is identifying a man who is accused of assaulting a woman during yesterday morning's subway rush hour. According to the NYPD, yesterday at 7:35 a.m., a 33-year-old woman "entered the Subway system at the Broadway Station [in Queens] in the confines of the 114 Pct and entered the 'W' train (Manhattan Bound). As the train approached 39th Street, the victim was sexually abused by the suspect who was sitting next to her. The suspect is described as a M/B/30's, 6'0" tall, wearing a black jacket, black knit hat and blue jeans. The victim took a cellphone photo of the suspect as she exited the train at Queensboro Plaza." I never question this sort of thing, but how would we deal with a false accusation? It's basically her word against him.
what exactly does "sexually abused" mean? Did he flash her? grope her? rape her? talk to her in a sexually aggressive manner? there isn't that much time between the Broadway stop and the 39th St stop.

Considering the transit workers thought it was appropriate to do nothing for a rape victim, I wouldn't put it past the general public to avert their eyes during this kind of incident. Case in point: my friend was once harassed then grabbed by a guy during the mid-morning hours on a Manhattan train near 34th St. Two or 3 beefy men around her pretended not to notice what was going on, and she ended up punching the guy before running off during the next stop.

The Manhattan-bound W is fairly crowded at Broadway at 7:35am and there is clearly a guy sitting next to him, so I'm guessing this wasn't a very serious assault.
Seriously, anything after 30th ave. is busy anyway, I don't ride at rush hour but I would imagine it was pretty packed.
Probably rubbed his leg against hers or something, I just can't see anything serious happening at that time on that train.
How are we, as commenters, supposed to judge this crime without knowing the details? We need to know these things so we debase the right person. I mean, I ride that train every day and could call any number of things that go on around me sexual abuse, especially when children rush head first into someone's crotch.

Almost all of its crime reports assume the police and/or prosecutor's and/or complainant's version. It is gratifying to see other commenters notice this as well! In USA, you are innocent until proven guilty
Hint to Gothamist: Try using "allegedly" and not spin every story with what the authorities spoonfeed you.
Isn't the use of the word "suspect" enough to connote the fact that this person is not in fact guilty, but "suspected" of committing the act?

A long time ago, I was riding a train once, and snoozed, and woke up with my head leaning on some woman's shoulder next to me. I apologized, but now am thankful that she did not take a pic of me and didn't claim I assaulted her.
Recently my ex gf told me a story. She got on a really crowded car, and some guy was standing next to her. So he pulled it out and started a self-satisfaction session. She was the only one who could see him. She had to be next to him till the next stop where she ran out of the car. That perv is still at large as she did not take his pic, thankfully she was only emotionally "assaulted".
I do believe the pic in this post is for a reason and some kind of a real assault did take place. Hope they find the suspect perv.

However, I agree that the language should maintain "alleged" status, just as other media outlets are required to do. Right now it says "apparently", which could imply that the Gothamist believes the suspect to be guilty, and that this is that suspect's photo.

Agreed. Just saying it's the police that now need to consider this when they give these to the news. And that Gothamist needs to say it's a pic of a dude who allegedly assaulted a woman, rather than implying that the pic is of the guy "who apparently assaulted a woman".

Are they? Click through to the Post article. Find the word "alleged" or any similar word. Both Jen's use above of the phrase "according to the NYPD" and the Post's "police say" are completely legitimate ways to make the report.
Well, yeah, not required, but you can be sued for libel.
They've edited the post and now it's factually correct - I think it happened between our posts, so the phrase I wrote about is gone. "a man who apparently assaulted a woman" is now "a man who is accused of assaulting a woman". Fine line, but a real one. Thanks Gothamist!
It's amazing how many ignorant remarks this posting generated. I was going to school in the 1970s when a well dressed middle aged WHITE male with a brief case on a crowded #7 train started to abuse me. The shock & fear kept me from doing anything and EVERYONE around me saw it since I was standing in the middle of the train holding on to the pole. So some of you should think before making stupid comments about things you know NOTHING about! I applaud the woman for doing something and hopefully stopping him from doing it again or any man REGARDLESS of race or class.

How anyone can denounce this woman as a fraud or liar is beyond me. It's that cowardly attitude that allows this type of harassment (and much worse)to occur. Instead of questioning her, why not step up when something like this happens and protect one another instead of going home and leaving your useless negative comments about it on the internet?
I agree. These people were NOT there and not in her shoes. They were too quick to question her veracity, just for their comments to be proven wrong when it was found out that he did this again and has so many charges against him. We live in a world where everyone loves to blame the victim.
