Around 10:40 a.m., a man was struck by a white Honda that apparently jumped a curb at Capodanno Boulevard and Seaview Avenue on Staten Island. The Staten Island Advance reported the man, who had been waiting, was pronounced dead at the Staten Island University Hospital 25 minutes later, and described the incident: "The 19-year-old driver's car apparently jumped the curb after making a turn onto Capodanno from Seaview, pinning the man between the vehicle and a pole that lists the bus schedule." The driver stayed at the scene and was questioned by police—but was not taken into custody.





Hmmm, 19 years old, apparently not drunk or high and he jumped a curb.
How much you want to bet he was texting or doing something equally idiotic on his iPhone/Sidekick/whatever?
My thoughts exactly. Those records are easy to pull.
If you ever want to commit a murder, it's obvious what the best weapon would be. Almost all of these stories end the same way: no charges filed, the driver released.
It used to be that you had to be in the street to get run down like a dog with no consequences to the driver. Now you can jump a curb and kill a pedestrian and not be charged? After that scumbag who killed the two children because he put his van in reverse got away with it, I guess I shouldn't be surprised.
If we ask our lawmakers to do something about it, my guess is that they'll just pass a bill making it easier for us to sue the auto manufacturers, while still making no mention of the dickbags who aren't responsible enough to have a license and a car.
This is starting to piss me off. Accidents happen all the time, but when you do it with a 2 ton machine in a city with millions of pedestrians, there need to be consequences.
Certainly it's true that a lot of incidents like this are considered to be "accidents" and don't result in charges... but I want to point out that the fact that he wasn't taken into custody at the scene doesn't mean that he won't be charged eventually. In the end it'll be up to the DA after the police investigation is complete.
I can understand not being able to create legislation around an automobile involved death that occurs in the street, as sometimes that is unavoidable on the driver's part (if the person darts out into traffic, for example.) But I do not understand the lack of prosecution for those who kill people when they are on the sidewalk. They should be charged with vehicular manslaughter by default.
jds is absolutely right. by the way, why not make the legal driving age 25 for staten island residents? i know there are idiots everywhere, but the amount of 16-24 year old idiots on staten island killing people with cars, driving around committing hate crimes, etc. seems prolific

Three years ago I watched as a bus ran a red light and ran down my elderly neighbor. She died in the middle of the street. The driver faced no charges or disciplinary action. Nobody seemed to care that he basically murdered an innocent woman whose only crime was walking slowly on a blinking red.
Father Capodanno is one of the worst streets on SI. All these young guinea assholes drive WAAAY too fast and aggressively on this road. These accidents happen more often than you think.
That is a racist comment. The driver was not from Guiana as far as I could tell.
All too often, those who are in responsible for filing charges in automobile incidents will find themselves relating more to the driver - than to the victim. Those in law enforcement can see themselves being involved in a similar kind of "accident" (although carelessness or negligence might be a more appropriate description) -- and are quick to dismiss the possibility of any charges.
So, instead of a judgement call, make it a law: if you are the driver of an automobile that is responsible for the death of another human being, whether or not it was your fault, you lose your license for life. On top of any possible criminal charges.
Even in cases where the driver is not charged, you can be reasonably certain he'll be sued into oblivion and won't have a pleasant life for awhile.

the 47 year old man was pronounced dead at the hospital, he recently became a grandfather.
the 19 year driver, just got his license in January. (and guess what, got a brand new 2008 hyundai from momma - he also looks like one of those growing up gotti wannabes)
