Around 5:30 a.m. this morning, a man was shot outside of the Cozy Soup 'n' Burger, the 24 hour joint on Broadway at Astor Place. According to 1010 WINS, the man was critically injured, after being shot in the back and neck; he was taken to Bellevue Hospital. Last summer, a shooting occurred outside the restaurant when two groups got into an argument (by the time the cops arrived, no one was there but there were gun shell casings...and a woman did eventually show up to a hospital saying her boyfriend was shot in the ankle).
Update: Jesse Chan-Norris heard the gunfire and took the photograph above.

Well, it's a popular restaurant that's open 24 hours—and it did happen outside it.
Yeah and there have been shootings there in the past, like the article mentions. That's the only thing on that block that has any activity that late at night.
Why wouldn't you report the name of the restaurant ? The argument was reportedly started in the restaurant. Says alot about the place if there is history of shootings outside the joint.

He may have gone out onto the roof of the parking garage next door to Cozy. The positioning looks about right. (I live in the building, too, and considered going out there.)

i got a cab outside of cozy 15 minutes before the shooting. i'm a little speechless.
