After Jersey City cop Martin Abreu was charged with vehicular manslaughter and driving while intoxicated, after allegedly striking two pedestrians—killing one and injuring the other—his mother defended him. The Daily News reports that a woman who identified herself as Abreu's mother said, "It was her fault," referring to 26-year-old Marilyn Feng, who died while crossing West Street at Albany in Battery Park City. The woman added, "So my son went out and had a couple of drinks. He deserves to have a good time now and then."
Feng and boyfriend Dennis Loffredo (both pictured at left) were walking to Feng's apartment at 3:40 a.m., after a night of tango dancing. The News reports, "Cops pointedly refused to say whether the couple had the light or not." Feng, who had recently graduated NYU Law school, was about to start a job at the Chinatown Manhpower Project helping immigrants find jobs, according to the Post. Feng once interned in Manhattan Borough President Scott Stringer's office; Stringer said she "had a great future."
Jersey City chief of police Tom Comey said, "The charges surrounding this incident are most serious and this type of activity will not be tolerated by the JCPD, which led to Mr. Abreu's immediate suspension. While Mr. Abreu was in no way representing our department when this incident occurred, our primary thoughts are with the injured and the woman who perished. Our thoughts and prayers are with their families." Abreu has been suspended without pay.





So if a cop gets shot by a guy trying to have good time, that is now justified? Martin Abreu's mother should be jailed as an accessory to murder for saying it's Feng's fault.
Sad story. It feels like an influx of hit and runs lately. This is why I now wait a bit longer at lights to cross and don't walk with an iPod.

Basic rule: Pedestrians always have the right-of-way. Pedestrians might be annoying (especially the jay walkers up in Harlem), but they still have the right of way.

IMO, this is exactly why Drunk Driving penalties need to be harsh. If you're dumb enough drinking and drive, you need to be put away, especially if you hurt someone.

I agree to some degree. I even see people look the other way while crossing the street even as a vehicle is coming; I guess what they don't see, won't hurt them. Or they assume they can get a nice juicy lawsuit out of it.

I walked across this intersection on Saturday afternoon and was shocked at how much construction was going on and how many concrete barriers and utility trucks were all over West Street, especially by the entrance to the Brooklyn Battery Tunnel ....there was no clear pedestrian path across West Street, and despite some useless "traffic agents" standing around, it was dangerous to cross this obstacle course even in broad daylight and with the traffic light in your favor....throw the book at this driver, but also hold the NYC Department of Transportation responsible for creating a consistently confusing and dangerous situation for pedestrians using this primary Battery Park City intersection...
Please - Don't mitigate the driver's responsibility for driving DRUNK.

West Street around Battery Park City is literally the worst pedestrian zone in Manhattan--it virtually necessitates that walkers sprint across multiple lanes of highway to get to where they're going.
There are elevated pedestrian crossings and crosswalks, but they're placed blocks away from each other. And the Brooklyn-Battery Tunnel enter-exit is thrown in for extra aggravation.
The existence of a highway, with little convenient way for pedestrians to cross it other than by jaywalking across multiple lanes, was a disaster in waiting.
That cop may have been over the limit, but West St. downtown is a pedestrian death trap.
I remember seeing on West St. right around there one night a guy who was slumped over the wheel of his Merc SUV, parked in the left turn lane. Somebody called the cops, and after about 10 minutes of shining flashlights and banging on the windows, because the doors were locked, the guy slowly wakes up and then speeds off, with the cops in pursuit. The cops caught him and breathalyzed him at .18, according to one of them.
It's not like officers really obey the driving laws anyway, even when they are off duty. Sadness. And the mother? Just a desperate attempt to protect her son. D-E-N-I-A-L!

Cops drink a lot. Often, it's a way to relieve the stress of the job, but knowing that they usually could get away with it, is another factor. Who's going to stop them? Local sheriff?
Some years ago, a brother of my co-worker was pulled over for DWI. Being a rookie cop, with career in shambles he shot himself next day. A month before his sister's wedding. Really tragic.

What a tragedy. If you break the law [in this case, drinking and driving], you are liable for any death or injury. Analogous to the law that says you are guilty if someone is killed when you commit a crime [ ie. robbery, even if you didn't kill them directly].
I remember when i was 25, i wasn't a good as driver as I am now. If by bad luck you hit someone, you have to pay the price. Especially when you drink and drive and speed, you take a chance. You lost the gamble, so you have to pay. Atleast 5 to 10 yrs in jail for involuntary manslaughter. Especially a cop who should know better than to do all 5 at once [drink, drive, speed, dangerous intersection, at night]. It's difficult to do more than 3 of those simultaneously.
