Alleged NYPD Subway Sodomites Appear in Court

Here's a lede you don't see every day, courtesy the NY Times: "A New York City patrolman used his baton to sodomize a man in a subway station, and two complicit colleagues helped him cover it up, the Brooklyn district attorney charged on Tuesday as he unsealed indictments against three police officers. Using graphic detail, the district attorney described an attack that he said left the man, Michael Mineo, with a gashed anus and blood on his hands." (We'll miss you when you're gone, paper of record.)

The accused officers appeared in Brooklyn Supreme Court yesterday for the arraignment, during which D.A. Charles Hynes charged that immediately following the subterranean violation, Mineo showed officers the blood only to be ignored. Officer Richard Kern, the sodomite in question, allegedly told him "that if he reported the circumstances to anyone, he would be arrested and charged with a felony." Hynes also compared the incident to the other notorious NYPD anal rape, that of Abner Louima 11 years ago, and he took pains to make sure the jury understood "the comparison, is that the allegation that an instrument in each case was shoved up someone’s anus." Got it!

The Daily News has it
that a plainclothes cop in the courtroom yesterday called Mineo a faggot, to which he responded by blowing a kiss. At a press conference later, Hynes told reporters that Kern, age 25, could be sentenced to 25 years in prison. Officers Alex Cruz and Andrew Morales have been charged with hindering prosecution and official misconduct for allegedly covering up the incident. Cruz's lawyer insists the D.A. doesn't "even have a paper-thin case." And Police union chief Patrick Lynch says the public should withhold judgment until the jury reaches a verdict: "We have earned the benefit of a doubt with our blood and sacrifice."

the officer actually may NOT have been off-duty. many use their shifts to pack the courts in support of their own. since it has become controversial for courts to be filled with uniformed officers, many have been required or volunteered to forgo the uniform. so, yeah, there is too much of what you say there is in the nypd, etc. and they totally don't care if they are doing it on our taxpayer dollar.

They should put these cops in the same cell with Justin Volpe, a broomstick and a can of Crisco and let them have a 25-year-long anus gashing party.

Sorry, I do actually feel awful for this fellow, and I expect he'll sue, and I think he has every right to do so. It's unfortunate that this happened, that these cops were morons who hurt the reputations of good cops, and that they've opened the door for yet further litigation that will be funded by the taxpayers.

Uh, yeah, no - no member of the NYPD has earned the benefit of the doubt. Once the NYPD actually practices it's "Courteous, Professional and Respect" motto in all interactions maybe, just MAYBE, police officers will begin to get benefit of the doubt and the respect they seem to think they deserve.

the medical records show injury to anus,
they have 2 police witnesses who came forward,
they'll get off like OJ.


I like how when it's the boys in blue it's 'innocent until proven guilty' but when it's anyone else (gasp, even a black, or even a homo-sexual!) is charged with an analogous crime it's KILL THEM AND FEED THEIR CORPSES TO THE PIGEONS.

from what they showed on the tv news, the reporter whipped out an expandable baton and even mentions it as an "expandable baton".

No, it was an expandable baton. Mineo didn't know what it was and guessed that it was a radio antenna, so that's where that report came from. Testimony from the transit cop on the scene was that it was the baton (sometimes called an "ASP," which is a brand name), and that's where Mineo's DNA was found.

Lynch should realize that a little bit of that "benefit of doubt" erodes away every time one his union's bad apples disgraces the rest of them.

I think we need to let the jury analyze the evidence before rendering a verdict.

I recommend a sniff test of the evidence.

I am trying not be prejudgemental, but doesn't the white cop look a little "weird"?

I thought the NYPD had much higher standards than this.
