For the third time in a month, the Klan has left some free periodicals--this time six-page pamphlets on terraces and driveways in Islip Terrace. The newsletter, known as The Klansmen's Voice, did not sound particularly controversial, calling on readers to "buy American" and inviting them to subscribe annually by sending a check to a Michigan PO Box. Since the flyering didn't occur on unsolicited automobiles, it is covered under the first amendment and not illegal. Elsewhere on Long Island this week, a murder case against Patchogue teenagers was charged as a hate crime and racist graffiti turned up on car windshields in Mastic.





This is obviously the fault of midwesterners.
Can anyone explain why it's not simple littering when you leave something unsolicited on someone else's driveway?

They purposefully stoked irrational fears about Obama (the "Socialist, Marxist, Islamic Extremist, Elitist, Leftist, Terrorist-Sympathizer") in the hope that they could pull white people away from supporting Obama. They stood by silently as their supporters shouted death threats and racial epithets.
McCain and Palin will play nice now for the cameras, but we should not forget the evil they fomented during the last few months of the 2008 campaign.

But I just can't wrap my head around how this isn't simple littering. If I left a washing machine on your driveway, it'd be prosecutable. Why is a piece of paper exempt? (Aside from a de mimimis argument)

You could avoid prosecution for that washing machine, if you could convince a court that the act of leaving it was communicating an opinion.
Slight exaggeration, probably, but there are any number of court decisions -- from jurisdictions up to and including the Supreme Court -- finding that laws can't restrain free speech... especially when the message is non-commercial in nature.
Basically here, leaving a flyer on a windshield doesn't impose a burden on the vehicle's owner sufficient to overcome the rights to political expression of the person who delivered it.
