Talking to police without a lawyer, at least for the initial interview, is standard procedure when people try this approach. If he's just a grieving husband, be doesn't need a lawyer. At some point he could have acted shocked that they were considering him a suspect, and then asked for a lawyer. But it would have looked suspicious to do it up front when he was playing the innocent role just trying to help the cops find "the real killer." Ultimately it's pretty foolish to think that you can outsmart seasoned homicide detectives, especially with the lack of planning in an "impulsive" crime like this.
