City: Massive Operation in Indian Reservation Cigarette Sales

102908smoke.jpgLast month the city filed a federal lawsuit against eight of the biggest cigarette dealers on the 50-acre Poospatuck reservation in Mastic, Long Island, where 11.3 million cartons of untaxed cigarettes where sold last year alone. Mayor Bloomberg argues that the sales deprive the city of $195 million in annual tax revenue, and city lawyers are seeking an injunction to stop the defendants immediately, the Times reports. Harry Wallace, chief of the Poospatuck tribe, says, "It’s just interfering and trying to interfere with the lawful retail trade on our land." But the lawsuit alleges that many of the cigarette proprietors are not even members of the tribe, and that each of the 279 residents of the reservation (including children) would have to smoke 19,200 cigarettes a day to account for the millions of cigarettes sold there in 2007.

oh they are not following the rules? Bloomberg, STFU, you are the last one to criticize any one for not following the law. TERM LIMITS, eh????? In fact, I will pay some packs from them today. Take that!!!!!!!

I wish somebody would go after the crooks at Fannie Mae with the same vigor.

As for the rules, Bloomberg has no problem with illegal aliens flaunting the country's laws. He's obviously quite selective who he thinks should play by the rules.

Maybe we should raise the tax on a pack of cigs to $100,000 each. Then we could sue the reservation for $18.9 billion!

Yuck! What a bad idea to go after Native Americans for tax evasion. Can we please get a real mayor? First a prosecutor (Giuliani) then a corporate CEO. NYC is not just a business, its a polis, a community. Why doesn't he do something useful like advocate for affordable housing. Dumbass.

i think i would give the Native Americans a free pass on just about anything... including coming and taking my land from me.

Several years ago I knew a girl who was buying cigarettes from Indian Reservations (she had been for several years) and not paying taxes. The IRS finally caught up with her and she owed something like $5,000. Had she used cash instead of credit she would have been scott-free, but she bought them over the web...

I had thought that the tax issue was the individuals responsibility. Shouldn't MB go after Joe the Plumber, Joe the Lawyer, and/or Joe the Banker?

For what crimes, specifically? Don't forget (or maybe you never knew) that the OFHEO sued Raines and other officers at Fannie. The government (lamely) settled the charges in April, and because of their employment agreements, the fines were all paid by Fannie.

Who is paying for this city lawsuit? I can think of about 5 million other things that could be done with taxpayer money than file lawsuits.

I'm seeing a lot of empty storefronts around town. Perhaps Mr. Bloomberg, you should focus on getting stores into those empty buildings?
