Paterson Aide Claims "Late Filing Syndrome" for Tax Problems

2008_10_obyrne2.jpgPreviously Charles O'Byrne, an aide to Governor David Paterson, claimed he didn't pay $200,000 in income taxes between 2001 and 2005 because he was dealing with depression (and he's paid off most by now). Now, O'Byrne's lawyer says he suffered from "late-filing syndrome" that made working on his tax returns hard.

Lawyer Richard Kestenbaum said, "Most times, with professionals, these are very high-functioning people who otherwise complete all the other ordinary tasks of their life... But there is something that they can't do, and many times that causes them not to be able to file their tax returns." Oh, and another mini-bombshell: O'Byrne, who was hired as a speechwriter for Paterson in 2004 at $178,500/year, actually had $300,000 in back taxes.

The Post spoke to the American Psychiatric Association, whose spokeswoman "said there is no such disorder or syndrome in the Diagnostic and Statistical Manual of Mental Disorders, a standard reference." And the paper also got this joking comment from an accountant: "Yes, it's quite common. A hundred percent of my clients suffer from this syndrome, and it gets especially bad every year as April 15th approaches." And an IRS spokesperson told the Daily News, "Wow."

As for Governor David Paterson, who had previously stated O'Byrne told him about his tax issues in 2004 and said he was working on it (of course, O'Byrne didn't file his 2004 or 2005 returns), he said, "He showed poor judgment."

Yeah, and I have late-getting-out-of-bed syndrome, but somehow I think getting to work at noon wouldn't fly.

What about "don't-want-to- pay-bills syndrome"? Isn't that a variation of "late-filing"? I need to call a lawyer and work this out!

Anyone who doesn't file their taxes knows it's wrong, this schmuck thought he could get away with it as a 'Mental Disorder'....I don't think so...

You should be ashamed of yourself for even pretending to have a mental disorder.

You just didn't want to file your taxes and realize that you owed a TON of money....greedy greedy man.

Big fucking deal. Lots of people file late. And in the end, the IRS gets a shit load more money in penalties and interest. So in a sense, late filers are better citizens because then end up paying much more than they would have if they had paid on time. I know this from first hand experience. This is just another non issue distraction. The guy paid. Don't we have more important things to talk about?

Technically you don't have to file so long as you don't owe the IRS any money. But that's stupid because most people end up claiming tax refunds that they won't be able to get. But I mean if you want to pay extra taxes and get no refunds... You don't technically have to actually file a return.

He's in the wrong office. David Dinkins had Late Filing Syndrome for years as well and he would up being mayor.
