Starrygordon is correct. It's obviously Fair Use, and the judge obviously has no clue about what's legal and what isn't, proved beyond any doubt when the judge also illegally interfered with the man's First Amendment rights a second time about the condoms. The judge should be fired for gross incompetence and be made to re-imburse the taxpayers for any salary he's collected while disgracing the bench.

So fucking lame. We are BOMBARDED with advertising EVERYWHERE. In cabs, on walls, at the gym, in bathroom stalls, on the phone, in the papers, you can't get away from having it in your face constantly. That this very same garbage that we are forced to ingest is protected from reuse adds insult to injury. Advertising has become so pervasive and unavoidable that it should be treated as works in the public domain when it comes to non-commercial parties reusing it.
