Viva Viagra Missile Shot Down in Federal Court!
Justice was meted out swiftly yesterday in the case of Pfizer vs. the Long Island Viagra enthusiast who gets his kicks cruising around Manhattan with a 25-foot decommissioned missile emblazoned with the priceless message 'Viva Viagra.' Yesterday we learned that the man, 48-year-old Arye Sachs, had no trouble getting the missile in and out of Manhattan through the tunnels because police were just so tickled by the gag. Not amused, of course, were the suits at Pfizer who, instead dismissing their overpaid marketing staff and hiring the obviously inspired Sachs, unleashed the lawyers. Now Sachs has to find a way to fill the empty hours that doesn't involve promoting a pharmaceutical company. And it gets worse—the humorless judge also ordered Sachs to abandon his hilarious plan to distribute politically-themed Viagra condoms. What's next—no more sidesplitting Viagra joke emails???

We are BOMBARDED with advertising EVERYWHERE. In cabs, on walls, at the gym, in bathroom stalls, on the phone, in the papers, you can't get away from having it in your face constantly.
That this very same garbage that we are forced to ingest is protected from reuse adds insult to injury.
Advertising has become so pervasive and unavoidable that it should be treated as works in the public domain when it comes to non-commercial parties reusing it.

The Viagra rocket looks like Fair Use to me. I don't think the judge knows the law.

Starrygordon is correct. It's obviously Fair Use, and the judge obviously has no clue about what's legal and what isn't, proved beyond any doubt when the judge also illegally interfered with the man's First Amendment rights a second time about the condoms.
The judge should be fired for gross incompetence and be made to re-imburse the taxpayers for any salary he's collected while disgracing the bench.
