After a judge declared a mistrial in the the animal cruelty case of a 205-pound man who killed a 7-pound cat, some of the jurors explained what happened during deliberations. The Post reported that "exhausted-looking" Shamsul Islam, Juror No. 11, said, "It was 11 to 1."
Joseph Petcka had claimed his girlfriend's declawed cat Norman attacked him, so he defended himself by kicking the animal. But the prosecutors pointed to the extent of the cat's injuries--multiple broken bones, broken teeth, lacerated tongue, chest full of blood--and his apparent jealousy of Norman (he said, "You love that cat more than me!") and said Petcka deliberately intended to hurt the cat. Juror No. 3, Douglas Collman said all the jurors but one believed Petcka's defense was "bulls---," and deliberations got very heated when another juror held out.
According to the Daily News, "When jurors took their first vote on Monday, it was 9-to-3 in favor of conviction. By Tuesday afternoon, it was 11-to-1." At that point, Collman said other jurors were shouting at Francisco DeFlaviis, "You're being irrational!" but "[He] thought it was an accident." Islam said, "He] just felt the evidence wasn't there. He said that there was some reasonable doubt."
The News reports that prosecutors may retry the case. Collman added his two cents, "He killed a cat and there should be some justice. I think he kicked the s--- out of the cat just out of anger. He knew what he was doing." But Petcka's lawyer said, ""He did not torture that animal. We're extremely sorry for what happened and we will continue to fight for his freedom." Petcka would have faced up to two years in prison if convicted for felony animal cruelty. He was also tried for harassing his girlfriend, but all jurors agreed he should be acquitted on that charge.

It was a jury of his peers, and apparently one in twelve people are sociopathic morons who don't see the problem in animal abuse. Roughly the same ratio as that of this comment thread.
Francisco DeFlaviis, the lone dissenter in this jury, did his civic jury. I am dumbfounded he felt Petcka was innocent and that his actions may have been justified. I think Petcka is a fucking scumbag for what he did. However Francisco DeFlaviis is not the villain here. His judgment may be fucked up, but he didn't murder poor Norman. As i have commented before, the jury pools in this city are frightening.
There's always the one prick in the jury box thinking he's Henry fucking Fonda. To the point where listening to the facts being argued doesn't even matter. The only thing going on in the juror's head is "Yeah... Reasonable doubt... I can doubt this reasonably! Fuck what this DA is saying. He won't fool me. I'm gonna save an innocent man's life. Wooooo!"

With luck, not only will she get a sizeable settlement from Westchester, the pig will go to prison, where he'll spend all his time alone in his cell because all the other convicts would be all too happy to see him in the yard or elsewhere. GM, iralarry, and jchez are right. While kicking cats to death is excessively cruel, this entire investigation and the response to it are completely disproportionate. Animal rights have, in some circles, superseded human rights. There should be no retrial; if they had the gall to have a trial in the first place they should've come to a decision. Why was this even a mistrial? If it was 11 to 1 then they ruled the man guilty. But sure; lets waste all this tax money to have a case about an animal, then slap all the tax payers in the face that much more by not acknowledging the fact that we clearly came to a decision. Then maybe we can have a retrial and expend yet more tax money.
And let the punishment fit the crime. We should bar this man from contact with animals, let him "burn himself alive", and make all of his income for the next ten years go directly to animal stuff. None of this is proportionate to the crime. Two years in prison isn't, either. My personal opinion is that since this is not his cat, he should financially compensate the owner. He does not deserve to die for killing an animal, nor does the juror that thought there was reasonable doubt. THIS IS JUST A CAT. The minute we equate the value of animal life to the value of human life we have deluded ourselves unforgivably. Yes, there is value to a cat. Yes, he was wrong to kill it if he could've avoided doing so, as I'm sure he could have. But when the same society that denounces the death penalty advocates "seeking and destroying" a person who has been proven guilty of nothing more than killing a cat, and even goes so far as to say that the juror "defending him" should die, I worry.
