As an 6 time ex-con, he was likely purposely avoiding the added assault charge. He could have put her freakin' head through the wall, UES feminist grrrl power notwithstanding. It would have been pretty stupid to die over an ipod, BB, and a remote control.

#5, maybe the story mentioned her job to further paint the woman as your average NY woman, who is NOT a cop, security guard, marital art teacher or even fitness trainer, all of whom might be more experienced to fight off an intruder. BTW, what's going on with the buglaries in the UES lately. Is this a sign of the NYC recession?
