Judge Doesn't Allow Umbrella Lawsuit See the Light of Day

2008_09_lecall.jpgA judge yesterday threw out the million dollar lawsuit over a broken umbrella filed by Nelio Balan, the owner of Madison Avenue hotspot Nello's. The judge then issued Balan's lawyer a $500 fine for wasting the court's time. Balan sued lingerie model Le Call over a $5000 umbrella he had loaned her and then never got back for a year, only to receive it back torn and tattered. He claimed he suffered "emotional distress" over the loss. With the lawsuit behind him, Balan's only hopes are for compensation of the cathartic sort. "An apology is in order. It's what is civilized...She never returned it. Is that normal, is that polite?" Balan said.

this is kinda sad. Sure, the lawsuit is frivolous but looking at the backstory it seems Balan was like a noble chivalrous gay who just showed the wrong romantic niceties to the wrong girl.

First sue for a million dollars, then request an apology. Yup, that's civilized. Balan's lawyer should have been fined $1M instead of $500.

I would have handed her a Totes. She's not even pretty, based on that picture. Sort of a "stoned Cameron Diaz" face.

Don't loan expensive shit to self-absorbed women just because they happen to be super hot and you think doing so might improve your 1-in1000 chances of getting in her pampered little pants. Douchebag deserves it.

You can bet the umbrella was not all he gave her.

I get upset when my $2.00 umbrella breaks during a rain storm. But if I could afford a $5000. umbrella, I'd probably just buy a car.

Most men move on when they can't get the panties off a particular woman, they usually don't file a lawsuit. He wouldn't give a damn about the umbrella if he got to tap that...

Even if the umbrella was worth 5K...why sue for a million???? Again...our judicial system is a joke!

I am thrilled the Judge threw this out of court and charged the idiot a fine for filing a frivolous lawsuit.

Now if we can get the other 9 out of 10 frivolous lawsuits thrown out the courts may be able to listen to REAL cases!
