Trespasser Tries to Zap Amtrak Back with Lawsuit

2008_08_bolt.jpgAn Astoria man is suing Amtrak because they "should have known that people trespassed" in the area of a Boston station where he was severely electrocuted two years ago. After a night of drinking in July 2006, 25-year-old Brian Hopkins went down to Boston's South Station at 2 a.m. after telling friends that he "wanted to get back to New York." There he tried to force his way inside an Acela and climbed on top of a parked train car when he was jolted by 27,500 volts from arcing overhead wires. He suffered third-degree burns over 85 percent of his body, and doctors have since amputated his left hand and leg. In the suit, his family claims that Amtrak should have taken more precautions to keep trespassers out of the potentially dangerous area.

    Isn't it true that insanity runs in all families? Maybe this guy got an extra dose! There is some suspicion of insanity in America's court system too. Let us hope that the judge assigned is having a good day and laughs this case outa court!!! Maybe he even might have the good sense to levy a fine and court costs on the trespasser for being a nuisance to Amtrak and society!!!

    The man was shocked. Not "severely electrocuted".

    Unbelievable, the drunk Ivy Leaguer gets banged up and climbs up on one of our Acela train sets and it is someone Else's fault. The scary thing is his Mommy and Daddy's money will hire the right shark and Amtrak will fold as they always do and pay up. The we should of cited him for trespassing that morning while he was still smoldering at Mass General. I would say "what a set of balls", but those where burnt off along with his leg and hand.

    I apologize if I offended. I just find it offensive that no one takes responsibility for their stupidity.

    wow, the story in The Journal News (from the link) is completely different than the version in the Post.



    "The White Plains man was standing on a Boston train platform when an overhead wire broke loose and shocked him in a freak accident."

    spoke to this guy first hand and her testimony can be used to show that this guy is not only an idiot, but a liar.

    He likely will win, even though this suit is completely ridiculous. I guess common sense isn't something we should expect from someone who just graduated from Yale (notice how he changed his story, by the way).



    As a burn victim, I sympathize with this guy's condition, but not at all with this lawsuit, which beyond frivolous.

    He'll probably win. Two Princeton students did the same thing a few years ago, one died, one severely and permanently injured after scaling razor wired fences to climb on the trains and hang on the wires. Apparently the "No Trespassing" and "DANGER - HIGH VOLTAGE" signs were too difficult to understand. They sued NJ Transit and won.



    Sort of wondering how they managed to get into Princeton to begin with...

    Maybe he should sue his friends too since they obviously did not try to stop him!



    If this even makes it to a trial it just proves what a joke our Judicial System has become.

    interlard, why do you feel sorry for him? It's his own fault for being where he shouldn't have been in the first place.



    I hope the judge looks him square in the eye, asks him "Are you serious?" and then proceeds to throw the case out of court.

    His injuries are terrible and I feel bad for him, but this is not Amtrak's fault. I guess he just needs the healthcare (don't we all)?

    Even if Amtrak knew others trespassed, apparently those others were careful enough not get electrocuted



    People have to use common sense - they can not expect others to constantly watch out for them and then start blame game when things go wrong

    and you wonder why fares are going up for train tickets. same thing applies to the MTA as well. dumb people suing train operators for their own idiocy. just our silly litigious society.

    Most people would have died with burns that extensive. He is extremely lucky to be alive. I hope the judge knocks some sense into him during this trial.

    It isn't like they have signs that say "Danger High Voltage" on the electrical bits of trains an the wire. Wait they do.
