Suspect Was Aiming Gun at Cousin During Fatal Shooting

2008_08_25cal.jpgThe Queens DA's press release gives some more details about the 18-year-old who fatally shot his cousin. Felix Cruz allegedly "pointed the firearm at her and pulled the trigger. The gun made a clicking noise and nothing happened. The defendant allegedly then pulled the trigger again, this time discharging a bullet that struck [Veronica] Cruz in the face, killing her." The Queens DA's office adds that Cruz tried to get rid of the gun by throwing it out a window. The Daily News says Cruz did take out of the magazine, but forgot about the bullet in the chamber, when "playfully pointing" the gun. Cruz, who was charged with manslaughter, criminally negligent homicide, and other counts, faces 15 years in prison if convicted.

Ummm... corect me if I'm wrong but - pulling the trigger the first time would have discharged the bullet. It wouldn't just click then *oh ok, bam!* on the second try if the bullet was in the chamber. Hmmm... somebody's lying.

In my own rambunctious youth, "playful" rarely meant "pointing a gun containing a bullet at your cousin's face and pulling the trigger one or more times." I shouldn't have been so afraid to try new things, apparently.

That sounds like first degree murder to me.

Only 15 years for murder? Sounds like first degree murder to me too with the accident "lie" to get it down to manslaughter. What is the DA in this case thinking? Manslaughter is when you accidentally kill someone with the car when you're DUI, or running the lawnmower without the shields in place and throw a rock that kills someone. Pointing a loaded gun and pulling the trigger isn't manslaughter. Put the guy away for life.

Are some people somehow incapable of not doing stupid things?

Make the punishment fit the crime; give the shooter a playful death sentence.

Could be the round misfired the first time, it does happen. Maybe the second hit with the firing pin got the primer working. It's plausible.

The round would not have been ejected from the chamber if it didn't fire. The mechanism that ejects spent shell casings relies on the explosive force of the bullet to send the slide back, ejecting the round. No firing of the bullet, no ejection of the round.

No such thing as "playfully pointing" a gun at someone. First rule of handling a firearm is every firearm is always loaded. No matter how many times you checked it, you never ever point it at anyone you don't intend to shoot.
