Are Charges Enough for Teen Driver?

2008_08_jchubala.jpgThe deaths of a couple immediately killed in their car when an unlicensed 17-year-old driver ran through a red light on a Grand Central Parkway service road has upset and outraged their neighbors. Jacob Chubalashvili, who stole the keys to a Mercedes from a family friend who was supposed to be watching him, faces many charges, including second degree manslaughter, speeding, and driving without a license after causing the crash that killed Ki and Hyek Young Kim Tuesday morning. The Kims' neighbor told NY1, "It's terrible, it's just terrible. It could happen to me it could happen to my family. It's just sad that things like this happen and that 17-year-old kid is going to get minimal time." Chubalashvili also told the police he had been smoking marijuana before driving.

    This depends on where he chooses to live, and the trend in the past 10 years or so has been to reduce disenfranchisement of felons.

    Manslaughter? He steals a car, drives under the influence with no license, runs a red light and kills two people and it's just 2nd degree manslaughter? Should be murder in the second degree, as defined by S 125.25 here:

    Under circumstances evincing a depraved indifference to human life,he recklessly engages in conduct which creates a grave risk of death to another person, and thereby causes the death of another person;

    Ok, so you throw him in jail , and after 30 years incarcerated in the big house he will learn the error of his ways. Then we can release him and he will become an outstanding citizen who votes, pays taxes, and assists little old ladies with crossing the street.

    That is what we'd like to believe, but we all know what this kid will turn into.
