Video of Cop Beating Man with Baton Surfaces

As the NYPD is caught in the controversy of a police officer apparently shoving a Critical Mass bicyclist to the ground for no reason, another disturbing video has surfaced showing a police officer beating a man repeatedly with a baton.

2008_07_nypdbeat3.jpgWNBC aired the footage which shows Brooklyn resident Michael Cephus being struck on Delancey Street in Manhattan earlier this month. According to police, Cephus was allegedly drinking and had swung at police officers with an umbrella, hit two cops with his fists and had refused to be handcuffed." The tape shows police officer Maurice Harrington beat Cephus while another cop handcuffs him. Cephus was charged with assault, criminal possession of a weapon (the umbrella), menacing and resisting arrest.

However, Cephus denied drinking and the charges and told the station, "I would never strike an officer. Why should I get beat up? Why should anybody get beat up?" And he said to the Post, "I was with some friends at a cookout.I stepped out of the park to get some ice. The officers told me I couldn't return because they said I had alcohol. I told them it was only ice. They thought I was drunk and they just came at me. They started swinging and hitting me with the batons."

Harrington, who works out of the 52nd Precinct in the Bronx (he was on the Lower East Side working a July 4th detail), was placed on modified duty. The Patrolmen's Benevolent Assocation's Patrick Lynch said Harrington's actions were necessary, "Partial video never tells the whole story. That person was not only not complying but gripping in a death grip that baton. That's a danger to the police officer."

    That was in the 13th precinct and nada in news worthy follow up.

    Don't know where you came up with that, but it's not NYPD policy and probably not that of any other department in the country.



    The baton is a compliance tool, used to stun a subject in the same way that a taser would be, so that he can be controlled. The idea is to start with strikes to the long nerve in the arm, next "upgrade" to the leg using the same "stun" approach, and if that doesn't cause the subject to submit the next escalation is to target breaking the long bones in the arms or legs.



    Yeah, it can be used to cause people to drop objects; it's the same approach: a strike to radial nerve will probably result in the subject losing his grip.

    Even on the cops' web site message board there is recognition, by seasoned officers, that the caliber of new cops has hit the level of recruiting individuals with criminal pasts.

    Can't we do better than this? Even teachers have to come up clean on their background checks. We, as taxpayers and citizens, must demand a better police force from our elected officials. I'm writing to mine today.

    One thing you learn from watching Cops is that the police expect you to comply with orders within seconds, and if you don't they go to work breaking the resistance. You never see them thinking "OK, we've got this guy on the ground, let him calm down for a minute." (He might wriggle away, I guess.)



    The larger question is whether the police department should operate the way civilians think they should. From the civilian's point of view, it seems obvious - we pay them. What the hell are they for if not to protect society in the manner society sees fit. But, cops are obviously deeply resentful of civilians even expressing an opinion on how they operate.

    I understand what a few of you are saying about resisting arrest, but you also have to realize he was being hit with a baton. It's not a "normal" respons to lay on your stomach when you're being attacked, and I'm sure he wasn't thinking clearly enough to say, "if I lay on my stomach, they'll stop hitting me." Indeed, we don't know what sparked the arrest, but cops need to learn an understand when it's necessary to use force, and to what extent. Even if this guy was resisting arrest, it's no excuse to beat him like that. The state of NYC police is frightening right now.

    Unless he was actually threatening them, a well trained cop in control of their emotions should be able to handle the situation without losing control and administering a beatdown. I see a guy writhing on the ground and being difficult, but not presenting any kind of threat. He's being annoying at worst. Three cops can handle that without resorting to excess.



    Too many folks seem to think a cop is justified in using violence in response to questioning of their authority. The job of a policeman is to protect society, not their own sense of pride.

    A) If the man was truly intoxicated and trying to sneak liquor into the park, why did they not charge him for that? Better yet, where are the bottles of liquor to be used as evidence?



    B) After they allegedly freed the man from his "dangerous weapon" (an umbrella) why do they continue to beat him senseless...ON THE LEGS?



    Resisting arrest or not, this is another case of brutal excessive force and lies to cover up those actions.

    Once again, the cop haters are out, maybe not in force like when that queer on the bike who was speeding and put other people's lives in danger got shoved, but they are out nonetheless.



    I don't see anything wrong with what happened in this Delancey street case. A cop was taking down a suspect. Big deal.



    The only two cases in recent history where I can say there was excessive force was the Bell shooting, and the Diallo shooting.



    Every other case seems about right to me.

    Totally unacceptable use of the baton. The baton is used for getting people to drop objects or drop to the ground only. This guy had no weapon and was already on the ground.



    Dipshit cop shouldn't have been trying to handcuff him with the baton in his hand, either, which is why he couldn't get the cuffs on and felt out of control and panicked and threw the baton (smooth move - throwing your weapon onto a public street), and then started hitting the dude. What a fucking moron. I hope they take away his badge, he obviously has no ability to function under pressure, and this guy wasn't even resisting!

    The on air footage last night showed some of the wounds - really awful. I'm all for hearing the rest of the story (from both sides) but it certainly looks like this cop is beating the hell out of this guy.

    I believe every word of Cephus's story - every word. The number of bullying cops in this city has crown exponentially since the days of "Giuliani Time". The fact that some officers are psychologically disturbed is no surprise nor is the fact that this mental illness surfaces from time to time in Police Wilding.

    These are the same police from a precinct that do not take restraining orders seriously. Every time I call them when I fear for my safety they take their time as my restraining order is being violated. When they get there, they tell the violator to take a walk when all the violations are clearly listed on the order and they have been violated which means this person should be arrested.



    But damn, a guy going to get ice not hassling anyone is a bigger nuisance to society than someone who is violating a restraining order.

    The NYPD tried passing a law restricting citizens' use of video cameras. Watching these videos it's pretty clear why. Now the NYPD and Bloomberg want to pass a law restricting citizens' use of air monitoring devices. Can't think why.

    And watching the video--which was seemed "edited for content"--why didn't he just turn over and let them cuff him?



    Getting cuffed by cops is always better than getting your ass beat. Sort it out with a lawyer later is always better than getting sorted out now--painfully.

    This sounds so unreal - to just get ice - OK



    This has nothing to do with the Times Square video where the officer is absolutely in the wrong. Everything the NYPD has said is like no one has seen the video.

    Here we go again. Maybe a little less cut-and-dry in this circumstance, but the lack of accountability shown by officers in their so-called "incident reports" on that bicyclist leaves their version of events here in doubt. Excessive force? It sure looks that way. If these cops don't settle down, they will be begging for a budget next year.
