Feds Accuse Yonkers Cop of Police Brutality

2008_06_ykrscopbrut.jpgAn 8-year veteran of the Yonkers police department was arrested for allegedly "body-slamming" a woman at a restaurant in 2007. Wayne Simoes was arrested and charged, per the U.S. Attorney's office, "with violation of federal civil rights laws" because it's illegal to for law enforcement to use "excessive force..the course of an arrest, stop, or seizure."

In March 2007, Irma Marquez's niece, who was hit with a bottle at La Fonda restaurant, was being treated by EMTs. Marguez, a health aide, was also trying to attend to her niece. According to WABC 7, the surveillance footage shows one cop trying to gently push her away. After she bumped into another officer while backing up, Simoes "approaches the woman, shoves her shoulder, and, after she apparently objects to being touched, suddenly grabs her from behind and throws her to the floor."

Marquez was thrown face first into the tile floor; she was in the hospital for four days, with a broken jaw and intense bruising on her face. Simoes was found to be doing his job while Marquez was arrested with obstruction of government administration and even tried this past May, despite her defense lawyer telling the Westchester DA's to look at the video (a jury acquitted her).

Now, with the federal prosecutors involved, other cops admitted that they saw Simoes throwing Marquez on the ground before handcuffing her and Westchester DA Janet DiFiore suggested the case was mishandled. Simoes could face a $250,000 fine and up to 10 years in prison if convicted.

I saw the video and it was incredible. This guy is an animal. The video shows the woman speaking with the officer and backing away from him, and the very next second, the brute is lifting her up off her feet and slamming her face-first into the floor. Even if the cop did have cause to arrest her -- which, from reading of the testimony of other cops in the news reports, it does not appear that he did -- what happened to just telling her that she's under arrest and cuffing her? Isn't that usually the step that police officers take before bashing someone's head into the floor?

 

What kind of savage does that to a woman? And what is a cop doing interfering with someone who might be helping a victim? You bump into a cop and you end up spending four days in a hospital?

The cops should practice a little of that CPR as advertised on the side of their cars.

There should be more charges than this. Why did it take more than a year for the other cops to speak up? Only now are they saying he used too much force. They should have said something in March of last year. Sounds like the blue wall of silence is built pretty high in Yonkers. And the DA should lose her job for not only pursuing a frivolous case against Marquez, but also for not investigating what happened to a woman who was so clearly and obviously brutalized. You don't get that injured by just falling down.

Just gotta love his attorney, who essentially said that because we can't read minds, we can't prove Simoes was trying to injure Marquez. Yeah, I guess he was using kid gloves against an unarmed 120 pound woman. I'd hate to see how he treats a man.

When are the police going to be held accountable for doing their jobs and these disgusting bastards removed from our streets?

Until people demand a real police force, we will continue to be abused by those we hired to protect us.

Then we can all rest assured that The Voice of Reason has exhausted all means to "reach the underserved minority population" and give up like everyone else has since the seventies. This is like the cops beating up the girl at Reagan National Airport in DC. There needs to be a federal overhaul of police brutality against women.

Police feel free to beat up whoever they want, even women and handicapped people. They just press false charges against them like Disorderly Conduct or Obstruction of Justice, after the beating, to make the police brutality look somehow justified.

Do you really believe that Janet Difiore did not see the video of the police beating? I doubt it. And what kind of Assistant District Attorney would prosecute this beating victim and deem this beating justfiable? A corrupt one who is covering up for the batterer cop. We need to end police violence against women, the prosecutorial misconduct and phony prosecution of victims now.

Honestly, did you guys watch the video? Obviously "ma'am please" wasn't working. These guys are cops, not third grade teachers. It probably would have been better for everyone involved if the lady had simply listened, and followed Police Officers orders.

I've never been slammed to the floor by the cops, but then again, I usually follow their orders. If I disagree with my treatment, I follow up AFTER the incident is over. No point in getting into a pissing match that you're gonna lose.

 

It seems as if there's a missing link between trying to brush her away from tending to her niece, and body slamming. If there was indeed a "misunderstanding" as the police claim, whatever happened to handcuffs? Surely there are other forms of restraint that don't involve body slamming.

Sometimes there are incidents involving questionable behavior on behalf of police, but you can understand why they may have acted a specific way. There is no excuse in this case; Simoes is definitely an animal.

Imagine a police force 10x as corrupt as NYPD's worst squads, and a city government about, oh, half as corrupt, and, well, welcome to Yonkers.

Nice to see things are still status quo up there.

After viewing countless videos of police brutality, I think I've finally figured out how the police cause people to *resist*. It seems to be an unofficial technique that some cops use to cause resistance which they can then use to to justify there brutality. I'm going to call this technique S.C.R.U.M. standing for

S=Smother the perpetrator (4-5 cops on top of the perpetrator so videos do not show what is going on nor can onlookers see)

C=Choke the perpetrator so he/she can't yell for help nor tell onlookers what is happening.

R=cause resistance by these methods:
1. Crush testicles causing severe pain
2. Crush kneecap causing severe pain
3. Twist ankle or knee in attempt to break joint

U=render victim Unconscious with TASER or via choking

M=Murder

The bald cop with his back to you can be seen squeezing and crushing the testicles of Deacon. Anyone would thrash around if someone did this to them.
