De facto means what actually happens in practice; de jure means what adheres within the actual law. In this particular case, the legal status of the trademark has been practically overtaken by the actual status of its use. I was attempting to differentiate between the alternate legal states.

I don't think a trademark can just "become practically a de facto part of the public domain."
