35K Settlement in Caliente Cab Restroom Gender Lawsuit

051308khadijahfarmer.jpgAnyone who’s ever declared, “You couldn’t pay me to eat at Caliente Cab Company” should consider the case of Khadijah Farmer, whose humiliating experience at the West Village tourist trap netted her $35,000 today. While patronizing the restaurant after the Gay Pride parade last year, Farmer was ousted from the ladies room by the bouncer, who interrupted her while she was on the toilet because he thought she was a he.

The bouncer, who had been responding to a customer complaint, refused to look at Farmer’s I.D., which proves her gender. He then added injury to insult by ejecting Farmer’s party from the restaurant mid-meal. In the settlement announced today, Caliente gets to deny the facts of Farmer’s complaint, but will add gender identity to its non-discrimination policy, adopt a gender-neutral employee dress code, and provide sensitivity training to employees. Oh, and cough up 35K.

The gender discrimination lawsuit was filed in October in State Supreme Court by Farmer and the Transgender Legal Defense and Education Fund. In a statement issued today, Farmer says she’s “very happy that the restaurant has taken appropriate steps to ensure that all patrons, regardless of how masculine or feminine they appear, are treated with dignity and respect.”

That thing looks like a man. I can't believe this cases wasn't thrown out.

Good for her. The bouncer, whose job it is to look at IDs, should have just looked at the offered ID and trusted it. The "reward" is for punitive reasons, and it's appropriate. A lot more appropriate than $1 million for hot coffee.

Is the following correct?...

A genetically male individual, who identifies sexually as a woman, but nonetheless looks like a man, is ejected from the women's bathroom by a bouncer who perceived the individual to be a man (and presumably a perv) in said women's bathroom.

...Given how confusing that is, and Khadijah's physical appearance (in the picture at least) $35k seems WAY steep to me.

Adopt a gender-neutral employee dress code? WTF.

The settlement is justified in my opinion. It's not about the fact that she was mistaken for a man; it's about the fact that the bouncer behaved in a threatening manner and refused to check her ID. All he had to do was look at the ID and all would have been well.

I'm somewhat surprised this happened in the Village. One would think that in a gay community, the businesses would be accustomed to patrons that challenge traditional gender appearances.

IDs can be faked & it was gay pride so she should have just flashed her va-jj

A commenter said this is much more reasonable than a million bucks for spilled coffee, but the coffee case was actually legit. Big industries like McD don't want us to know that--they'd rather us make fun of an old lady who had to have skin grafts because a corporation wasn't listening to dozens of complaints by customers who were being severely scalded by their too hot coffee.

Wow, there are some crazy comments on here. But lawsuits like this are very important for getting companies to treat people fairly. It's easy to say, ooh, I'll take the money, humiliate me! But this woman has gone through almost a year of legal woes just to get the restaurant to change its ways, and the restaurant still never openly admitted fault. Sickening.

Where does it say she is TG? I thought she was merely a masculine-looking woman. I can't find anything about transgender here.

It doesn't say that farmer is trans-gender above, I was going off of this:
