unless you are in your home, there is a duty to retreat.   If the story is right, Frazier attacked Dunn, Dunn ran and Frazier chased him.  Dunn then fought back with a razor.  It sounds like Dunn retreated before using the razor, so he probably has a decent claim to self-defense.  

The biggest problem for him will be showing that Frazier hitting him with a bottle was deadly force.  Also, possession of a razor with intent to use it unlawfully against another is a class A misdemeanor in NY... so that also might pose a problem.  The fact that Frazier was  diagnosed as depressed and schizophrenic probably will work to Dunn&apos;s favor.&lt;/p&gt;</description>

If he still had the bottle in his hand, maybe, but it sounds like he was unarmed, even though he was beating the crap out of his friend.&lt;/p&gt;</description>
