I don't think people go to "strip/whore house"s thinking they will be shot at 50 times. The Kalua Lounge did have a shady history, but to be fired upon so many times seems extreme.

a serious moral flaw: The victim was in a strip/whore house...THAT makes him a dubiuos individual. If their family fail to see that, thay are missing HALF of the case.

And wouldn't both sides need to alter the presentation of arguments during a bench trial as compared to a jury trial considering that there is a different "audience" deciding the outcome
