A New York State senator is proposing a law that makes criminals legally responsible for the inadvertent harm to helpful bystanders who might come to the aid of a person under attack. The proposal comes in the wake of the death of Flonarza Byas, who may have been killed by Maurice Parks while he was defending himself during a robbery.
The media are calling this a strengthening of the Good Samaritan law, but when we think of that, we think of the law against not helping someone in obvious need. That's the law that got the Seinfeld Four locked up during that show's series finale after they laughed at a fat man being robbed as they videotaped the crime.
The newly proposed law stems from the death of Flonarza Byas, who may have been killed by subway conductor Maurice Parks. A number of men attempted to rob Parks earlier one morning this month, unaware that Parks was trained in the martial arts, had previously shot a mugger years ago, and was carrying a knife for self defense. In the ensuing mano a mano combat, Parks may have been the man who fatally stabbed Byas, who may have been coming to the aid of either Parks or the men he was defending himself from.
In the mind of Sen. Eric Adams, who exactly killed Byas is a moot point. The law he is proposing is meant to hold the people who initiate criminal action to be held accountable for its consequences, whoever is injured or killed as a result.





Because this law seems to be so clearly aimed at irrefutably violent crimes, it sounds like a good idea to me.
There are lots of horrible and oppressive laws in New York, both at the state level and the city level, but this isn't one of them. Hope it passes.

I guess all the good laws have been thought up already. It must suck to be a senator. Needing to justify why people elected you in the first place by bringing up shit laws that sound reasonable at first glance but when looked over with the microscope of logic have tragic flaws.
There is probably a law that already deals with this. What they need to be doing is getting rid of laws before they make any new ones. That way the hacks in Albany could actually earn their money.

Actually Good Samaritan laws most often protect people coming to the aid of other people from being sued. There were some ridiculous cases where someone would save someone's life by giving them the Heimlich maneuver, only to have the person turn around and sue them for cracking their ribs in the process. Most states have these laws to cover people whose job it is to rescue people (fireman, cops, EMTs, lifeguards) but several have ones that will cover anyone coming to the aid of another.
Voila, a new crime law on the menu. Got to feed those upstate prisons, Senator.
I need some help here. First we argue that our legislators don’t do enough. Then we say they do too much. I don’t know about you but I like what this guy has been doing. He introduced bills dealing with domestic violence, hit and runs, and now innocent people killed during a violent felony. For a freshman senator he is extremely active. People who cause innocent people to be killed should be held accountable. I am sure many who disagree will feel different if their family members were the victim of such an act. This senator is on target with the issues that impact every day people. His law on hit and runs was right on target. My car was hit and the selfish person left the scene. Since I only had liability insurance I was left with picking up the entire tab. I also like what he is doing with his “Child Safety Book.” As citizens we need to do more time supporting good lawmakers and not just sitting back complaining. It does not take much to criticize. You should also go to his website to see some of the things he is doing. I am not impress with many elected officials but I do like what I see in him.

it's not a matter of doing too little or too much. It's about doing it right.
I (not my car) have been the victim of a violent crime and the solution is not to double or triple laws that are already on the books. What's easy is passively accepting yet another law that promises to strengthen our security but in reality only strengthens the overly empowered federal and state prison and policing industry.

This doesn't even make sense. Do you even understand what this law is supposed to do or do you think the guy who inadvertently killed a bystander while trying to defend himself should go to jail for murder?
Basic facts: if these assholes weren't trying to rob this guy, Byas would not be dead. It seems pretty clear.
