The off-duty police officer who fatally shot an unarmed Bronx man earlier this year was indicted on manslaughter charges. The indictment will be unsealed today, and police officer Raphael Lora will be arraigned. Manslaughter has a maximum penalty of 25 years.
On a May night, Lora ran outside of his home when a minivan, driving the wrong way on the street, crashed into a car on the street. Lora chased the minivan, which was driven by Fermin Arzu, a Honduran immigrant, and confronted Arzu. With the driver's door open, the minivan lurched forward and Lora fired at Arzu five times, and one of the bullets went through Arzu's back and pierced his heart, left lung and aorta.
Lora said that though he was out of uniform, he identified himself as a police officer and was wearing his badge around his neck. He also claims that Arzu stepped on the gas, but some witnesses say the car was moving slowly. Arzu managed to drive a block and hit another car, causing a fire. Arzu's blood alcohol was found to be 0.17, twice the legal limit.
Arzu's lawyer Sanford Rubenstein, who is also representing Sean Bell's family, said, "This is the beginning of the journey for justice for the Arzu family." However, Lora's lawyer Stuart London said his client "acted professionally. His intention was to render aid, to assist an individual who was intoxicated. My client needed to protect himself from deadly force by discharging his weapon. He was concerned that he was going to be dragged underneath that vehicle."

One word. Al Sharpton.
Right, let's NOT indict an off-duty cop who runs up to a drunk driver and shoots him. That's the way they are supposed to act. I love how the lawyer claims he was just trying to help the guy.
If only that evil Sharpton would leave cops alone. Granted, he's nowhere to be seen in this article, but we all know he controls the entire media and justice system now.
I think a trial is required.
Regardless of the politics, a man was shot to death.
Sharpton? What about the lawyer Sanford Rubenstein? Defending Sean Bell and now this guy? gimmie a break.
this cop should be indited. okay, the guy was drunk and driving on the wrong side of the street but that's what happens when you get your buzz on. but the guy also opens the driver's side door. his foot must have slipped on the gas by accident or he forgot to put it in park (that tends to happen when you've been sipping on the SoCo & soda all night) and was wondering why some dude (a Transit cop, mind you) was telling him to pull over while waving a gun around. So what does the cop who supposedly never shot his gun 'in the line of duty' do? He fires 5 times a moving vechile where a bullet find its way into the guys back. Nice! Ace in the hole for this transit po-po. Um, how come things like this never happen on the show Cops?

If Arzu's family are here illegaly, their journey should end back in Honduras.
