Custody Dispute May Have Led to Queens Murder

2007_10_annadale.jpgPolice suspect that the daytime murder of a Queens orthodontist may be related to the custody of his daughter. A long and bitter divorce battle had granted temporary custody of five-year-old Michelle to 34-year-old orthodontist Daniel Malakov. The doctor was dropping his daughter off to his ex-wife when someone shot him three times point blank in the chest.

When Malakov arrived with his daughter at the Annadale Playground in Rego Park, his daughter ran to greet her mother, Dr. Mazoltuv (Marina) Borukhova, a doctor at a Long Island hospital. An unidentified stranger then approached the orthodontist and shot him. The murderer, described as wearing a dark jacket, ran from the scene. No shell casings were recovered from the scene, meaning that the killer paused to pick them up or used a revolver pistol that doesn't eject shells, but the silencer, made out of a bleach bottle was dropped at the crime scene.

Burokhova didn't attend his funeral, and his parents and relatives are accusing her and her relatives of orchestrating his murder. According to Newsday, "Police sources said detectives have not ruled [Burokhova] out as a suspect, but note that she tried to save Malakov by performing CPR." Police are investigating the ex-wife's relatives, who allegedly threatened Malakov after he gained custody of Michelle.

The former couple's divorce lawyers confirmed to the NY Times that their divorce was extremely acrimonious, calling the case "unpleasant" and "most contentious." And their child is currently in the custody of the Administration for Children's Services.

Let's suppose, for a moment, the wife, an ER physician ('well-liked,' I suppose) had something to do with the dentist's ('well-liked,' we already know) murder. What does that say about her dedication to the Hippocratic oath? Anyone convicted of a crime can have their license to practice medicine suspended...in the meanwhile, if you were the director of the ER, would you have her continue to treat patients?

I think it would be fair for a supervisor to suggest she take some time off. But this story is just sad - and if the ex or her family were involved, they totally did not consider the fact that the child would go into custody of ACS.

I think it was the wife's family, but that the wife probably wasn't in on it. It's unlikely she would be so stupid as to have him killed while she's there with him in a playground picking up the child for visitation. However, she probably told someone in her family that he would be there dropping the child off and they took that opportunity to have him killed.

BTW, can I just say that divorce with children is something you really, really, really want to avoid.

The child going into the custody of ACS is extremely frightening given their track record of stupidity. Turn the kid over to his mother.

I dunno, I've heard that the negative effect of divorce on children depends on whether the parents can act like responsible adults or not. Here it sounds like the ex-wife, at least, was a psycho. (The custody battle included the standard molestation charge, for one thing.)

Yeah, Jibbly, I agree. Turn Jack McCoy loose on the shooter. Y'know, sometimes I think the only way to get to the bottom of something, or to get justice, is to see if Sam Waterston has the morning free to go to a precinct/jail/suspect's home, to grill him or her for a few hours.

All seriousness...has there been anything said, about WHY the daughter was given to the father? What exactly was going on in the divorce to make it so horrible? So far as I can see, its just another idiotic shooting. Are people jumping to conclusions, that the ex was involved? I mean...who'd want to have thier daughter see her father murdered in front of her?

Of course on the other hand...the ex could be a wacko who hired a hitman.

The judge ruled that the mother had not cooperated with visitation orders. Lawyers involved in the divorce have described it as particularly acrimonious, including (as I mentioned above) an allegation of molestation against the father. The child has not been returned to the mother.

the Guilty party here is the Ring master of the Circus JUDGE SIDNEY F. STRAUSS I am in his court now for a year and a half trying to see my child , I have not seen my no Four year old daughter for that time . I have petitioned and petitioned Strauss over and over , Then ----AGAIN WITH ---- OUT----A--- HEARING ----he all gave sole custody of my Child to my wife , the judge is unbelievable. He also would not enforce the Preliminary Conference, orders of MY health insurance by my wife , he tells me too get $3000.00 of medical work done and send the bill to my wife , I am unemployed from the United Nations because my wife had me arrested for dropping off a B-Day present to my child. My wife moved my child from the house - also violating the PC ,the judge says nothing , he ordered that We ( Wife and I ) Do the Act parenting classes- I finished the classes- my Wife did not- I told the judge to have my wife comply , he said he didn't care. I hadn't spoke to my child for 9 months i told the judge --, the judge said nothing.
My wife made False allegations of Drug Abuse against me , ACS sealed my case as unfounded , Judge Strauss says get a evaluation from a STATE agency , "Agency" replies to Court I have no substance use issues what so ever if there is a question have me randomly drug tested , Judge still doesn't not allow visitation with my child. Three months later I am told to get a hair follicle test , The test is negative , the judge still does not allow me visitation , Then the judge then unbelievably tells me to enter a drug treatment program any way , I ask for the health insurance cards to absorb the costs , he doesn't enforce his order of health care , I pay to enter in the Outpatient programs the result from TWO different programs is they will not admit me to the programs-- as stated " HE (me) does not have any substance abuse issues what so ever we are denying you admittance to the Program"
I bring the reports to the judge , HE still does not allow me to see my child . What do I have to do here start using drugs ? so I can get into a program so that i can see my child ??
This Judge needs to be taken off the bench , he is like 75 years old and senile .
In the mean time my wife has spent $30,000.00 on her attorney , they fill a motion of contempt stating i'm wasting time in court and want me to pay her attorney fees , and its the judge who is dragging the case on for ever. I file a cross motion , And the judge stated (BY transcript ) HE (wife's Attorney ) has to answer my cross motion by January 22 2009 ,
HE (wife's Attorney) never answers me , judge Strauss writes a final disposition of the case , with out me being in court , Stating my cross motion is denied gives sole custody of my child to my wife, sends the equitable distribution hearing to next the JHO (judge) and no visitation (hearing or otherwise) has been set up for me with my child , Judge Strauss Hands me $8000.00 of child support to my wife , when I only earned $11,000.00 not following Child support guidelines at all , and hands me $2400.00 to my wife for the order of contempt filling yet my wife attorney doesn’t even respond to the Cross motion of contempt , What the Hell is Wrong here???, . Sounds ridiculous, ITS all sad but true I have all the papers and evidence , What do i do about seeing my child ?? Go Malikov , I think not , I go to unset this ridiculous Decrepit Judge so he can never do this again . If some one can help me please feel free , rwd67@live.com
