iRate iPhone Owner Sues Apple Over Price Cut

2007_09_iphoneluanch.jpgShowing that there are no bounds to lawsuit insanity, a Queens resident is suing Apple for marking down the price of the iPhone - and she wants $1 million. Why? Because now she can't sell them for a profit on eBay! Damn you, Steve Jobs, and your possibly faltering precious product!

Dongmei Li claims that Apple "violated price discrimination laws" when the prices of the 8GB iPhone were slashed from $599 to $399 and the sale of the $499 4GB was stopped. The "less favorable" terms of a 4GB purchase, rather than an 8GB purchase, are mentioned in the suit - Li had purchased two 4GB models with the intention of selling them on eBay. Ouch, but technology will bite you in the butt every time.

Li's lawyer Jean Wang explained, "Since they're selling the 8-gigabite phone for $399, there's really no market for her." So, wait, is she in the cult or not? AT&T is also named in the lawsuit.

    They need to somehow punish the lawyer for even considering taking a case like this. Price Discrimination Laws doesn't have to do with individual buys devices from a store (even with an intent to resell, it's still not a business), it deals with businesses selling to other businesses, and making sure that one store doesn't get a better deal than another on a discriminatory basis.

    #18, the point is still why would you try to sell something on eBay that isn't in high demand at a retail store? It makes some sense if you buy a Christmas toy that is in high demand because parents must have the toy by a certain date. and eBay sellers can quickly snap up all of the Elmos and Wiis in a particular area. But there is no rush on the iPhone. In fact, savvy people know to never buy a first generation product. Wait for the other chumps to find the bugs.

    Not even commenting on her legal case but what idiot tries to sell iPhones on eBay? From Day 1 there was no shortage of the phones. eBay is only good if you can get a scarcity premium - especially if you're paying retail rather than wholesale. This nut should have returned the phones a long time ago.
