They need to somehow punish the lawyer for even considering taking a case like this. Price Discrimination Laws doesn't have to do with individual buys devices from a store (even with an intent to resell, it's still not a business), it deals with businesses selling to other businesses, and making sure that one store doesn't get a better deal than another on a discriminatory basis.

It makes some sense if you buy a Christmas toy that is in high demand because parents must have the toy by a certain date. and eBay sellers can quickly snap up all of the Elmos and Wiis in a particular area. From Day 1 there was no shortage of the phones. eBay is only good if you can get a scarcity premium - especially if you're paying retail rather than wholesale. This nut should have returned the phones a long time ago.
