City Council May Ban Smoking While Driving Kids

City Council member James Gennaro will be proposing legislation that will prohibit smoking in cars carrying minors. The Sun reminds us "if enacted, smoking in cars with riders under the age of 18 would join a growing list of activities barred by the city, including making too much noise at night, serving trans fats in restaurants, and allowing students to carry cell phones in school."

Gennaro says, "We want to continue to fight to denormalize smoking," pointing out cigarettes, out of the 4,000 chemicals they contain, have 150 that are "known to be poisonous." Fines would start between $200-400 for a first violation, and then rise to $500-1000 for the second and $1000-2000 for the third. Mayor Bloomberg hasn't commented about the legislation yet, but we bet he signs it.

As for civil liberties, Gennaro told the Sun, "Boo-hoo. You can't subject kids to 43 carcinogens and 250 poisonous chemicals and claim privacy. Get over it. Their right to privacy doesn't extend so far as to poisoning kids."

They don't want anything added to the nice exhaust fumes wafting up off the highway or particles of brake lining...don't forget the injections of mercury at birth and the glory of flouride...yeah they're real concerned.

Where does it end? We do not need the government to tell us how to live, do we? Common sense should be enough for an individual to make correct choices for their life. Not making it a law. Too many laws and no one to enforce them anyway. Otherwise children would not die at the hands of their parents..... Enough already!

Are they serious? Enough with this crap. They are all just looking for sound bites at this point and it's really getting annoying.

They should also ban smoking while walking, as it is really annoying when one of these selfish assholes is spewing forth smoke forcing others to breathe this crap. If you want to kill yourself this way, please do, but keep the smoke to yourself and don't force your stupid drug habit on others.

This is great. My parents smoked around us all day, including trapped in cars. I smelled like smoke as a little kid, my brother got asthma, and although I am extrememly health conscious today, I have many health problems because of my parents' habit. It is a mild form of child abuse.

I'd be 100% behind banning tobacco products and their usage completely if we didn't generate tax revenue from idiots and their bad habits. Oh well. We should really get crackin' on legalizing the harder drugs.

I'm a smoker that is trying to quit. However I feel that smoking is a bad habit to pick up (should have listened to my smoker friends before I started.) Making smokers feel guilty for smoking is not going to make them quit. Bottom line, if the suits want people to stop polluting the clean air for non-smokers, make it illegal. If they aren't prepared to do that then they need to find some other way to release their hot air.

My hatred of the City Council grows every day. Regardless of the issue at hand, the condescending way Gennaro delivers his message is infuriating. "Boo-hoo"?!?! Try delivering your position without sounding like a know-it-all.

Remember how well Prohibition worked? Like there wouldn't be delivery services operating 10 minutes after a ban went into effect. The cigarettes would likely be either made on an Indian reservation or smuggled through one.

You know these Council people are beginning to really bug me ! While I to understand the motive here for banning smoking in one's car, This is a little overboard ! It's like telling a smoker they can't light up in their own home because it poison's others whom breathe in the vapors . As a "Part-Driver" myself, If I were a smoker there would be a serious problem with someone telling me that I couldn't light up in my ride ! Alcohol, I can see because it impairs the abilities of it's victim (That being the Driver) ! That makes all the sense in the world, but smoking in the car with passengers is just going to far ! Yeah it's sad society has become so dependant on these corporations that make use dependant on these drugs.

My neighbor leans out of her bedroom window and smokes. It smells like someone is standing in my apartment smoking. I can't put my fan in the window--and yes, I've asked her not to smoke when my fan is in the window. I would even just ignore it if she did it earlier in the evening. But considering that she smokes at 8:30 pm or 10, or 12:45 or even, my personal favorite, 2 am, I think that a ban I've heard SLC has would be appropriate--something like you can't smoke within 40 feet of a building. Which would be funny--people smoking in the middle of the street here. Heh heh. Gripe and moan all you want smokers, but I'm sick of inhaling your carcinogenic habit. Kill yourself slowly, by all means, but do it away from me and mine.

Make it totally illegal. Not the same as alcohol which has SOME beneficial qualities and can be ingested safely. And people who do it SHOULD feel bad. Maybe if they felt bad enough they'd try harder. (Sorry to those who have tried and failed, but many think it's their God-given birthright).

I agree smoking around children is a form of child abuse, and I really wish people were smart enough to refrain from doing so, but on the other hand this law is a little extreme.

I feel to start smoking banning in cars is moving us closer and closer to living in a police state. Why should NYPD spend thier time watching out for these people, when there are FAR more serious crimes they need to work on stopping, like kids shooting each other in the subways.

How exactly are they going to enforce this? Are police going to start pulling over drivers who are smoking and then ID their passengers? It just seems impractical.

The little conspiracy theorist in my head keeps pointing out that this gives the police yet another reason to pull people over without anything resembling "probable cause."

I'm not sayin, I'm just sayin.

i'd only be for this if the $$ would offset some the parking fine B.S. no new money for the NYPD. we all know they're not protecting us from terrorists. i see them in the subway all the time just hanging out talking about "the game." so if they want to charge people for this. stop calling it a moral crusade, we know from the education system that this city doesn't reeeally care about kids. just say, if we charge these exorbitant rates from bad parents, we'll cut down on all the towing of your car when you park three inches too close to the 90th fire hydrant on your block.

SMOKE FREE NYC!!!!!

I work at 42nd and Lexington and am dying from the smokers on the streets and in front of buildings. It's like walking through a Vegas casino. I have seen women with babies scream at the smokers who think nothing of exhaling the smoke around the kids. I am wondering if it occurs to smokers who are walking on the street that there are people walking behind them who don't want to inhale that stuff ? It's really disgusting.

It is illegal to smoke anywhere outdoors in the town of Belmont, California.

I have had this fantasy that one day all those smokers who make the NYC streets so unpleasant would one day, when they want to smoke, have to go up to some godforsaken outpost far away - maybe East New york. Make it really hard to get to. All the smokers would just stand in one enclosed place. Maybe they would get a sense of how hard it is for the rest of us to be assaulted by smoke.

36-38: It's such a slippery slope -- if we start to ban everything we find unpleasant where do we stop? As #3 said: We are inhaling much more toxic things all the time that the city council is doing nothing about.

I'm not a smoker, I'm just wondering how much control you want the government to have over our lives. I think less is more in this case.

Less is more in any case. Amazing how many people in this post are willing to sign their freedoms away as long as it's behavior they don't like. Of course it cuts both ways, so just wait until something you like to do gets banned and we'll see if you change your tune. And the road to serfdom continues...

It is illegal to sell cigarettes to people under 18 and illegal to obtain cigarettes for people under 18. It is NOT, however, illegal for people under 18 to either have them or smoke them.

IE: people under 18 do not get fined or arrested for either having cigarettes or smoking them.

I'd like all perfumes banned. I hate smelling it and I'm allergic to it. Why can't I get my pet peeve made into a law?
