Brooklyn Man's Murder is a Hate Crime

Supreme Court Justice Jill Konviser has ruled that the three men charged in the murder of Michael Sandy can be charged with murder as a hate crime. Last October, Anthony Fortunato, John Fox, and Ilya Shurov had lured Michael Sandy through a gay chat room to meet them near the Belt Parkway. When Sandy arrived, they robbed and beat him, causing him to flee into the highway and get hit by a car. Sandy was critically injured and after many days, his family decided to turn take him off life support.

The Brooklyn DA's office charged the trio, who are now 20-21 years old, with murder as a hate crime, but their lawyers argued that the crime did not meet the hate crime definition. One defense lawyer said, "He was targeted because he would (a) come alone, (b) bring drugs and/or money for drugs with him, (c) go to a deserted spot and (d) probably not offer much resistance...Consequently, the crimes alleged are not crimes of hate but rather crimes of opportunity."

Justice Konviser found, "The grand jury evidence shows that this is not a case where hate crimes are charged simply because the victim just happened to be of a particular sexual orientation. Rather, this is a case where the defendants deliberately set out to commit a violent crime against a man whom they intentionally selected because of his sexual orientation. Thus, the hate crimes charges in this case are consistent with the intent of the Legislature."

Hate crime convictions come with much tougher sentences.

society will not miss these people. i hope they're put away for a long time.

Why does it matter whether he was killed because he was a certain color? Why do other murderers get less of a punishment because they did it because of money, jealousy or any reason other than hate? Hate crime laws are bullshit. If you want harsher penalties, then every murderer should get one.

I agree. Also, what ever happened to the group of black kids who chased a white kid into traffic uptown a few months back? The kid gave money to a panhandler and a group chased him? What happened to that hate crime? All these PC laws for hurting or killing different types of people just weakens all the progress made. In my opinion.

Hate crime laws are motivated by a policy to protect members of marginalized groups. It's meant to discourage crimes motivated by racial animus, which arguably isn't an assault on an individual but a discrete community. It's not mere political correctness, so stop harping on PC like Rush Limbaugh circa 1992. Harp on the judge or the judgment if you disagree with it.

He wasn't killed because he was gay. He was killed because he had money on him that the criminals wanted. The only reason his gayness enters the equation is because the criminals used it as a lure to get him to go to Plumb Beach by himself.

BTW, I spent many nights at Plumb Beach back in the early 80's and before it was a gay pickup spot. We used to get high in the parking lot, drink 40's of Olde English 800 on the beach, and build bonfires out of the wood fencing put up on the beach to keep the sand off the Belt Parkway. That place has been a known trouble spot for decades and very little was done to stop it.

damn skippy, the most disadvantaged and discriminated group nowadays are White, protestant and straight.
they're the homeless and the ones you see during hurricane Katrina. where's the help for this group?
they're the ones making minimum wage and have no health insurance. they don't even have their own TV channel.

I forgot to add it's the white, anglo, straight males who gets the shaft day in and day out, 24/7, all day and all night.

Of course, that's their defense. It's a pretty good one, basically anybody who manages to not utter a slur while assaulting somebody could claim "I was only doing it because..." (Heck, that lunkhead from South Brooklyn (uh, Howard Beach? can't remember) actually did utter the N-word while beating down somebody with a baseball bat, and he used this defense.

I recall that the killers had used gay chat rooms to lure other gay men to that area. In fact, the three men specifically targeted gay men because they knew gays were vulnerable and therefore less likely to report that they had been victimized. Yes, it was a hate crime.

I think most posters here are getting the facts wrong . This guy was killed "Intentionally-Not on purpose" ! What that means is that while the pursuit lead to his eventual death, It wasn't the root cause of his death . It was the initial result of his death & that doesn't make this a hate crime . The attackers who set him up were interested in robbing him, not necessarily beating him . They used the rouse of a sexual encounter to lure him to this desolate location to rob him ! The point the Prosecution is trying to make is that they want the fullest extent of the law applied here and this is the only way they can make that happen .Posted by; "Still Not Amused"

Either way, My friend Mike Sandy got killed because of these three kids that decided to rob him by beating him down and chasing him down the highway. These kids that decided to rob my friend Mike deserves every charges they get. Why? Mike is dead because of them thats why.
