Brooklyn Cop Shootings: Guns and Not Guilty Pleas

2007_07_timoshenfun.jpgYesterday, the three men charged with first-degree murder of police officer Russel Timoshenko all pleaded not guilty in Brooklyn court. However, Dexter Bostick, Robert Ellis, and Lee Woods, who were also charged with a number of other crimes related to the July 9 traffic stop shooting, did not ask for bail. The Post and Daily News had the varying statements the men gave investigators:

Woods, 29, told detectives "I ain't going to jail for something I didn't do. I didn't shoot no cops, I was only driving. Fat boy [Bostic] was in the passenger seat and that faggot Roger [Ellis] was behind me."

"I didn't shoot no cops," he said. "I'll tell the DA, the judge, whoever I need to tell. I'm not going to jail for life."

Ellis, 34, said he was driving his ex-con pals around "looking to get some money, rob someone on the street," when he heard shots ring out.

Timoshenko's alleged killer, Bostick, 34, claimed, "I wasn't even there."

Brooklyn DA Charles Hynes said that the death penalty would not be pursued. NY State does not have a death penalty, but some had suggested that the case should go to federal prosecutors; Hynes said, "There is no such federal connection in this case." Patrick Lynch of the Patrolmen's Benevolent Association said that NY State should have the death penalty.

Hynes also added that there was a wealth of evidence, based on surveillance video and the weapons found, "I have never seen the kind of forensic investigation that was carried on." It turns out that the gun that killed Timoshenko was from a Virginia gun shop, whose guns have been involved in 1,000 crimes. Further, the same .45-caliber Llama was used in a Queens shooting on July 8.

And last Thursday, thousands of people attended the funeral of Officer Timoshenko.

I bet the percantage of people actually pleading guilty to a crime off the bat is like less than 1%. Plea Bargains rule Americas court system. Sad.

The mayor is in St. Louis barbering for more federal gun laws. How about we enforce the laws that are already on the books first. It is a violation of federal law for a New York resident to purchase a firearm in VA. Thanks to the fed's contiguous state law, one may only purchase a firearm in the state in which one resides or in a state that touches the state in which one resides. If a New York resident buys a firearm from any state other than NY, PA, NJ, CONN, MASS, or VT, they have commited a felony. If a holder of an FFL (federal firearms dealer license) sells a firearm to any one from a non-contiguous state, they have commited a felony. If you are a person who is not qualified to purchase a firearm (convict, crazy, drunk, etc) and you ATTEMPT to purchase a firearm, you have commited a felony. The anti-freedom lobby loves to talk about all the people who have been prevented from purchasing firearms by the NICS system (national background check computer), so why have NONE of those people been charged with the felony that they commited by attempting the purchase? Answer: the anti-gun lobby gleefully tolerates a great deal of "gun crime" so they can make heartfelt appeals for more money and more laws. With the proliferation of incompetant law enforcement in this city, I'll choose self-defence with my firearms over 911 any day of the week.

What happens with these Virginia gun purchases is that a Virginia resident acts as a "straw man" for the New York buyers. The Virginia resident buys the gun from the Virginia gun shop, and then resells it at a markup to the New York buyers. Because the Virginia resident's purchase was completely legal, the gun shop violated no law and cannot be prosecuted (his resale to the New York buyers is, of course, illegal).

I thought interstate flight of felons was in federal jurisdiction?

#17, The use of the word faggot should not be troublesome as it a quote within a cite. Censorship is wrong no matter where it comes from and prudish, ham-handed attempts to infantilize language lessens us all. Racism is nonsensical and homophobia is going the way of the Dodo (not quickly enough though) but words carry only what power you (the reader) give them.

The national unemployment rate for black males of working age hovers around 15 percent, which is higher than any other group, but nowhere near 60 percent.

Yano, for a board centered around New Yorkers, there's some pretty racist motherfuckers on here. I grew up mostly in this town and partly down south in Florida and I didn't see half the crooked ass racist motherfucking POV's down there that I see up here.

Its really quite astounding.

man, i can't believe this is happening.

i used to live with roger(robert) for a short time. he didn't seem like the type of person that could do something like this. sure hes not a saint, far from but hes not as bad as people are making him out to be. years ago i was on the phone with him when me and my mom was in a fight about something and she kicked me out and he drove from queens to long island to pick me up and let me room with him for a few months; he was always respectful to me, he was honest about what he was into what he did, etc and when i first saw the report on the news i didn't want to believe this was the guy i used to stay with. i know ppl want his head on a stick now but i just hope things went a bit better for everyone that was involved in this. i have no clue what actually happened that night but i dunno, i don't want to jump to conclusions based on what the media is saying because from day one, even before i knew one of the suspects was roger, i knew they were bad mouthing the suspects.
