They're definitely profiling when they ask for your receipt. It's happened to me a lot less since I was struck by "lightening."

nobody is legally required to show a receipt upon leaving a store. so how can they sue if they weren't even legally required to show their receipts?

That doesn't make any sense. A store can do whatever it wants.
Although I should add that when I say whatever they want I mean as long as they don't discriminate on the basis of race, gender, or religion. They can make everyone show a receipt and this white male has always been required to show a receipt at both Manhattan CompUSAs.

Toys r us never asked me for a receipt, the only big box store that stops everyone is Best Buy.
I've never been asked to show receipt and open bag at the other stores. And, only at J and R when you pick up from their pick up area.

Stores are private property. The enumerated rights of the amendments to the Constitution do not apply to private action. Statutes may, the Constitution does not.

Perhaps they have a basis for their claim (other than they were stopped and are black), but either way, isn't 400 million a tad excessive?
Graying guests is a bit annoying and ineffective. The "guest" handle is clear enough. Besides, the "member" handles are no less annonymous after all. "Accountability" in this case is just a choice for folks to build a clear identity, which should be a choice, not a requirement. Most readers of Gothamist got past 8th grade and can tell at a glance if we want to fully read a post or not. How can the the cutting edge of NYC blogs be so internet retro?
