Woman Crushed by Drunk at Shea Sues

2007_04_masseymets.jpgRemember Ellen Massey? She's the Mets fan that had her back broken while watching an April game at Shea Stadium. Sitting in the upper deck, Massey had an "oversized" man, who may have been drunk fall on her, breaking one of her vertebra. Now, Massey, who had two steel rods placed in her back, is suing the Mets,, their concessions vendor Aramark, the service union that includes stadium security, and "John Doe," the man that fell on her. The man has not been found yet or come forward.

Massey's suit alleges that stadium employees "knew or had reason to know from his behavior that he was already intoxicated," and it's because of their negligence that he became "unruly, uncoordinated and fell." Her lawyer says that she's still in pain and will need another operation. Despite all her pain, the lawyer also says, "She's still a fan and she wants them to win the World Series."

The Mets believe the suit has no merit and Aramark said they were still reviewing the lawsuit. The suit seeks unspecified monetary damages. Aramark previously lost a lawsuit stemming from a 1999 incident when a drunk man paralyzed a girl after a football game at Giants Stadium. That verdict was overturned in 2006 by a New Jersey appeals court.

I fail to see how it's the Mets fault that they draw so many fat drunks to their ballpark.

I suppose if he was a skinny drunk, like the guys in the bleachers at Yankee Stadium, she wouldn't have a case?

If it were an accident at a Yankee game, someone would have slipped on a puddle of grease dripping from the heads of all the cheesy guidos at the game.

I think that she deserves a settlement for what happened to her . Sadly, It's the Mets fault here, As well as the fat bastard that fell on this woman . You can't have the vendors policing there products at ballgames this isn't a bar where you can cut-off a patron that's had enough . It's a public event on a grand scale here ! It's unfortunate that this happened but if the Mets start policing this where will it end ? Are they going to start specialized seating for the Fatties, & Chunky's who pay there hard earned dough to watch their team play ? I don't think so . What they should do here is draft a release of liability that states "If you purchase tickets to this sporting event, You are responsible for your actions as well as the subsequent actions and results of those within you're person . In addition to your purchase of these tickets, You agree that in the event of unforeseen actions taken The Mets, & all Subcontractors are without liabilities" .

There are a couple of real fools posting here tonight. Tim, if your Mother got crushed by this drunk slob I'm sure you would pursue the same avenue as Ellen Massey has. Shea stadium served the booze, kept on serving it and are very much the liable party (along with Aramark). As for Drew, I'm sure she will get "over it" when they can remove the rods and she collects her lawsuit money. Ellen Massey faces a lifetime of pain and like I said, there are some real fools posting tonight.

Alcohol is the number one fuel for idiocy and should not be served at sporting events, on planes, etc. Ellen, get well soon and I hope you win your case.

My late mother was a good Bronx girl, which means she wouldn't be caught dead among the white trash at Shea. So... wrongo...

This woman definitely has a case under the law. My bartending class definitely covered New York State Dram Shop Liability. Whether it's fair or not, the law is pretty clear on this. Establishments can be held liable for damages caused by an intoxicated person which they served while he was intoxicated. I don't see Aramark beating this one.

My dad owned a bar in Detroit for fifty years. A fight broke out in the bar and a person was stabbed. That person sued my father. My father lost. If you are the owner of an establishment that serves liquor and something happens on your premises where injury occurs, you're liable. Michigan or New York, same difference. Sorry Shea. You lose.

basically, anyone weighing in at over 300 pounds shouldn't be allowed intyo a baseball game. The guy would take up two seats!
