I'm a lawyer, and no, this is not assault. To be guilty of assault in New York you must cause physical harm to another person. In addition, you must cause such harm with either criminal negligence, recklessness or the intent to cause such harm. Lightly stroking someone's hair does not satisfy any of these elements. Battery is a tort, not a crime, so as a plaintiff you would have to prove that the intentional unwanted and offensive touching caused you harm. While you might be able to prove that the touching was unwanted and maybe even offensive (if you're very sensitive), it would be very difficult to prove that it caused you any harm, and virtually impossible to collect any damages. The most likely result is that you would be laughed out of the courtroom. I find it somewhat amusing that so many people are willing to claim that touching someone's hair is assault or battery, yet they laugh at a woman who successfully sued for having her genitals melted off by coffee that was heated to a significantly higher temperature than allowed by law. Oh, and the reason why such behavior might be taken more seriously (at least by the people being touched, if not by the justice system) if committed by a man is because men commit the vast majority of sexual assaults. Also, women make up the majority of the victims. It's that simple. If you men don't like it, try to do something to stop your fellow males from raping and assaulting women. And, for your information, it is very unlikely that a man who went around touching people's hair would be convicted of any crime. As I stated above, in order to be convicted of a crime, your actions must satisfy the elements of the crime as set down in the relevant criminal statute. If a man were running around rubbing his dick against people, that might qualify as some type of sexual assault. Similarly, if you punched someone in the face because they touched your hair, you would likely be guilty of assault.

Um, actually, Poor Bastard, in the bios on their website, two of them claim to be NYU grads. I think the folks pointing the NYU finger at them are making the point that NYU students, past or present,seem to have a slightly inflated sense of entitlement. Also, for what it's worth, the juxtaposition of that mission statement, which someone quoted above, with this pointless video is far more hilarious than the video could ever hope to be.

If I ever encounter these girls or anyone who touches my hair for that matter, they're getting more than they bargained for in return. What I can't understand is how the victims don't turn around or say something. Are they stupid? Do they not feel someone is touching them? Or are they afraid? Are they actors and is this all just some stupid publicity stunt? In any case, the whole thing is really dumb and I can't wait to hear in the news--if this is true-- that one of them got their arse kicked because someone felt the need to protect themselves from these assailants. For what it's worth, there was not a single incidence of even minor violence left on the cutting room floor (are there still cutting room floors?). Also, not to burst anyone's bubble, but none of the girls go to NYU or have a trust fund.
