Girls Were Needed "To Fight Whatever Girls We See"

2006_10_nicoledufresne.jpgYesterday, one of the teenagers that mugged and terrorized people on a January 2005 night testfied that Rudy Fleming did not shoot Nicole duFresne by accident. Tatiana McDonald, who was 14 during the fatal mugging (she's now 16), told the court that the group of teens were bored after smoking marijuana and playing video games, so they decided "to start trouble."

After trying to mug a man of his leather jacket and being scared away from another man who seemed to have a gun, the pack of teens were walking in the Lower East Side when they saw duFresne, her fiancee Jeffrey Sparks and two friends. McDonald said Fleming wanted to "bang on these people right here" and confronted them by grabbing duFresne's purse and hitting Sparks with a gun. From the NY Times:

“What are you going to do, you going to shoot us? Is that what you wanted?” Ms. duFresne demanded, according to Tatiana McDonald, one of the muggers, who testified yesterday in State Supreme Court in Manhattan.

As Ms. duFresne shouted those words, she walked up to Rudy Fleming, whom Miss McDonald described as the 19-year-old leader of the pack, and looked him in the eye, Miss McDonald said. Mr. Fleming reacted by pushing Ms. duFresne in the chest with his left hand.

Ms. duFresne stumbled backward, then bounced back and shouted her question again: “What are you going to do, shoot us?”

Mr. Fleming pushed Ms. duFresne a second time, and when she came at him again, he lifted his right arm and fired one bullet, Miss McDonald said.

“He was so mad, he just lift up the gun and shot at her,” Miss McDonald said. “After I saw her grab her chest, I just ran.”

McDonald, who admitted to going through duFresne's purse, maintained that Fleming did not slip and was not pushed by duFresne (Fleming's defense is that he shot duFresne by accident). She also testified that the guys wanted her and Fleming's girlfriend “to fight whatever girls we see." Fleming's lawyer tried to paint McDonald as someone who did have a major role in the crimes.

    Our children

    Not safe in this world

In this world a child use to be--able to depend on you and me..

But! today the you and me’s of this world--are the one’s abusing and hurting our innocent boys and girls..

Today our neighbors and friends have become the enemy--fear has locked our windows, our doors, we aren't even free..

Today instead of ABC’s 1st. our children are taught to protect our selves--yes! no one is safe, not even the young or frail..

Today our children are no longer safe behind their own locked doors--because friendly sounding people are silently, killing, and abusing our boys and girls..

These molesters come with a smile on their face--as they make the family comfortable standing in their space..

Abusers befriend and blind us to the point we can’t see--Molesters mean no good to our kids or you and me..

They rape and abuse our kids --snatching them right out of their own beds..

The child starts to trust those they should fear--being smothered by intent even, mom and dads message they don't want to hear..

So the befriending makes the wrong seem right--the smiles, the conversation, the understanding, even what should be fright..

So when the trust is in place they snatch our boys and girls--as the child realizes to late, children aren't safe in this world..

  • Idiots: Thank you.

  • so there

Idiots: that was an incredible letter. I think most of the people blaming the victim have themselves never been in this kind of situation and don't realize that rational thinking can be impossible.

I'd always wondered which I'd choose if faced with either an attack dog or a human with a weapon. I might be inclined to say the human because there's a slight chance you can reason with him. In reality it's not the case.

Mensch: I'm actually not in favor of the oil aspect of the current war, but was just trying to illustrate a point; is defending yourself in 2 inch heels vs. a military uniform "stupid?" Or is it "heroic" only if your government tells you to do so?

  • mister hand

    why, thank you, sir.

Karma? hahahahah, those projects in the LES will be there forever, how's that for karma?

    boriqua pride.

  • concur

Unfortunately karma doesn't exist in real life so we have to endure the excrement of people like mumbles when bad things happen. People like mumbles are the ones who SHOULD get shot.

  • mumbles

The mugger should of shot your friend for "mouthing off". I know I would.

You know she got lucky. All it takes is one nervous mugger with a finger on the trigger.

We all have bad days but I bet your bad day is a picnic compared to others.

so how bout you Shut the F*ck up?

  • bob

    i agree.

  • Idiots

I love all the tough-talkin' morons who think they're so "urban," pissing on a dead girl because she was from Iowa and stood up to a shi+head whose balls came from a gun. I have a friend who was walking by an alley when a kid aimed a gun at her and said, "give me your f_cking money." She'd had a bad day - - a really unbelievably bad day. So bad that she was unwilling to even fully process the gravity of the situation. All she saw was the arrogance of this douchbag threatening her life. So she looked at him and said, "F_CK YOU," and kept walking. Nothing happened. Should she be dead? Is that what SHOULD have happened to her? She knows she shouldn't have done what she did, but she's a human being and at that moment she was not thinking rationally.

The first time I had a gun pointed in my face, the first thought that ran through my mind was, "shi+, now I'm going to have to get a new drivers license and cancel my credit card." It wasn't until the bad guy was emptying my friend's pockets that I realized that my life (the only one I get) was in his hands and he could kill me for no reason at all. It's horrific, but that moment of clarity doesn't always happen immediately, especially if you've had a few drinks.

If you've never been the victim of a violent crime, then you have no idea how something could set you off. I could see myself becoming enraged like Nicole was. No, it's not "smart" but she didn't grab the lowlife's gun and shoot herself. Every time you walk out the door you're putting your life in strangers' hands. Some of those strangers are pieces of shit. When one of those sociopaths kills an innocent person, it amazes me how many other potential victims rush to chime in to say how stupid she was and how she deserved it. How civic-minded. Let's all be like that and New York can be like the early eighties again. People who say that sort of thing have obviously never had a loved one murdered.

    Just shut the f_ck up.

"Just wondering...to everyone posting the nasty and "stupid" comments here...do you say the same to family and friends of those who have died defending the country?"

Defending the country, no but only those families who willingly let their sons and daughters go and get shot off in a country they have no business being in and getting killed so oil companies can profit from the occupation. Now that's stupid.

  • jim

it's a sad and unfortunate situation and I feel terrible for the girl and her family. one can't help but note the irony that this girl was a hardcore white liberal who would have probably advocated for more leniency towards poor minority misunderstood "youth" like her killers.

  • cramily kircus

I don't know what your case is but It was not I who called her "stupid".

And, I'm sure some did call the packin granny stupid for having a load gun. And, anything can be used against you, those people going to La sur table with their kitchen knives could be used against them. However, I don't think the NYPD returned said gun, I bet all she got was a receipt. (and, if she wants the gun back it's going to be a difficult battle)

  • so there

There's no shame in walking away alive to see another day. NO ONE and I mean NO ONE would ridicule you for walking awy.

No one's denying this...but if you want to be nitpicky don't you think the city grandma should have known her loaded weapon could have easily been used against her? No one called her "stupid" despite the well known rule involving attackers and self-defense weapons.

  • dirti harri

If she was from Iowa then her farm smarts would of known that was a .357 Magnum pointed at her head.

If it was a mouse gun then maybe you had a chance.

But to confront someone with a hand cannon is another story.

There's no shame in walking away alive to see another day. NO ONE and I mean NO ONE would ridicule you for walking awy.

The grandma in the wheelchair most likely had a loaded gun in her fanny pack.

  • so there

The kind of shit that flies at your high school in Iowa or whatever doesn't always work with kids here.

Because a lot of kids here are barn animals? :)

The name calling seems to have to do with her background more than anything. I've lived here long enough to many stories of confrontation from those who grew up in the area; not all of them backed away. When they stood up to the attacker, they fancied themselves "courageous." When a white girl from the Midwest does it, they replace it with "stupid" (example: the recent Harlem lady in the wheelchair who confronted her attacker - nobody called her "stupid," even though the attacker could have easily wrestled the gun from her hands).

Where do you draw the line between "brave" and "idiotic?" Pretty arbitrary if you ask me.

Using this logic, fighting in Iraq and defending our country can also be considered "stupid."

Although I personally would not have said this to someone pulling a gun on me, I'm certainly not in the position to criticize what she felt was right at that moment. It could have gone either way, so perhaps if she'd survived she would be a hero? I also suspect that some of the haters are secretly annoyed that someone with her background actually had a set of balls...oh wait, she wasn't over in the Middle East, so I guess that means she was "stupid?"

  • kil

navy seal style pencil is AWESOME!!!

  • Jonathan

Maybe this will serve to remind people in these filthy new money years: if you wanna move to New York, wise the fuck up on your street smarts. I don't give a fuck if this girl was a "passionate, dramatic" person. The kind of shit that flies at your high school in Iowa or whatever doesn't always work with kids here. It's a shame she died, but...shit happens. Some people are just fucked.

  • so there

Just wondering...to everyone posting the nasty and "stupid" comments here...do you say the same to family and friends of those who have died defending the country?

  • hessie haymes

as above, there's ways to downgrade an incident and other ways to inflame an incident.

Even cops use verbal judo. I don't know if it's as effective as Navy Seal style Pencil holding.

You have to know your battles and know when to hold them and when to fold them.

    And, when to walk away.

  • blabba

it's not about blaming... it sbout avoiding. sheesh. the mugging/robbery/whatever was happening, but the shooting coulda been avoided.

the first thing my moms taught me, when i started taking the nyc subway on my own at age 12 back in the day (19 freaking 81 from brooklyn to manhattan), was just hand over the damn money.

what's worth more your money or your life?
