NYC Man Charged with Offering Hezbollah TV

The U.S. doesn't like the Hezbollah, and U.S. Attorneys certainly don't like Hezbollah TV, as they charged Staten Island TV salesman Javed Iqbal with providing customers with a Hezbollah TV station in a satellite TV package. The U.S. Treasury called Al Manar a terror organization earlier this year, leading to the feds to bust Iqbal. The Foundation for Defense of Democracies' Mark Dubowitz tipped the feds about Iqbal's transmissions, and then here's the Post's explanation of how he was found out:

In June, a "wired" FBI informant walked into Iqbal's Brooklyn office, asking to be hooked up to the "DISH network."

The informant explained he was Lebanese and wanted to watch the Lebanese Broadcasting Corporation, which transmits secular or Christian shows. Iqbal asked if he was "Lebanese Christian" and when the informant said no, he asked, "Why don't you watch Al Manar?" court papers say.

He described different service packages that would allow the customer to receive Al Manar and other Arab networks, including Al-Jazeera.

Court papers also say Iqbal falsely told the customer that Al Manar broadcasts were legal in the United States - and a month later changed his sales pitch to say they would soon be legal.

Of course, this case is testing civil rights issues, and the NYCLU said, "It appears that the statute under which Mr. Iqbal is being prosecuted includes a First Amendment exemption that prevents the government from punishing people for importing news communications." But Dubowitz calls Al Manar "a terrorist organization masquerading as a TV channel" that broadcasts "bank account numbers where viewers can donate money to Hezbollah and other terrorist organizations."

Iqbal, who is a legal resident of Pakistan, is being held on $250,000 bail.

  • Well, this is certainly a new approach to censorship - declare a TV station a "terrorist organization" and then outlaw it. The fact that this "terrorist organization" is only armed with cameras and microphones is unimportant - at least to the sheep who want the government telling them what to think.

    Yeah, yeah, we in america are so much better than anyone else because we have freedoms - chuckle.

    Guys, let's slow down here. There are many tv stations which are broadcast around the world that are anti-American, anti-Western, anti-Semitic. Only one is on the Treasury's list.

    Why?

    Simple...Treasury gathered proof the Al Manar was providing survailance for terrorist attacks, providing bank account numbers to drop money into in an effort to fund suicide bombers, and calling for attacks on civillians.

    That is what separates Al Manar from other stations.

    As for the first ammendment arguements...1) It doesn't protect Al Manar because they are not a US corp. (and even if they were, the above actions in support of terrorism would negate their rights under us law), 2) Freedom of Speech even in the US is not with out restrictions. This is why our friend in NY, whether Pakistani or American, isn't in the clear.

    We all have freedom of speech, but none of us are allowed to yell fire in movie theatre.

    With rights come responsibility.

    This is further proof that the United States of Amerika keeps slipping into FASCISM under the 'leadership' of our glorious Fuhrer GW. It's the same censureship that happens with Al Jazeera, which our government wants to block from transmitting into the U.S.

    Maybe it's because Al Jazeera airs videos of all the little babies and children that we're bombing "into democracy & freedom". It's hard to enjoy breakfast I guess when you see a little girls body that's been raped and set on fire by US stormtroopers.

    I can understand the reason behind the censureship tho; It's hard to support a war 'against' terror when it turns out WE'RE the biggest terrorists.

  • "terrorists suck"- you cannot honestly tell me that the US doesn't have civilian casualties when it is off in, oh let's say, Iraq, and is plowing through dropping bombs? I'd say that's insanley innaccurate. Laughably so.

    The funny thing is, that to me, according to the PAtriot Act info above, perhaps we should be banning Fox news for "intimidate(ing) or coerce(ing) a civilian population" with fear.

    Rob, the missiles the US fires into other countries have guidance systems and are aimed away from civilians. Hezboallah just lets loose on heavily populated areas and HOPES THEY KILL CIVILIANS. In fact, if there is one thing to admire about the whole mess is that it started because Hezbollah's BORDER INCURSION was to kidnap actual soldiers. If these guys and their supporters want to start whining about war crimes, tell them to strap on a uniform, sign the Geneva Convention, and fight like real men. And stop hiding amongst the civilians.

    USA PATRIOT Act defines it as a group who has "activities that (A) involve acts dangerous to human life that are a violation of the criminal laws of the U.S. or of any state, that (B) appear to be intended (i) to intimidate or coerce a civilian population, (ii) to influence the policy of a government by intimidation or coercion, or (iii) to affect the conduct of a government by mass destruction, assassination, or kidnapping, and (C) occur primarily within the territorial jurisdiction of the U.S."

    If Hezbollah falls under that definition, doesn't Israel also, especially "to intimidate or coerce a civilian population?"

    It it's a standard channel just distributing information, even "trash and garbage," this definitely seems to be an egregrious violation of the First Amendment.

    However, if it was indeed soliciting funds for terrorist organizations as defined by the U.S., that is a whole different story.

    It is illegal because the man Mark Dubowitz, who "tipped the feds" had created a campaign under the Coalition Against Terrorist Media to get the U.S. Government to name al-Manar a Specially Designated Global Terrorist organization. By adding al-Manar to this Treasury Department list, it allowed sanctions to be placed on any U.S. or foreign company doing business with al-Manar.

    Executive Order 12947 specifically prohibits Americans from engaging in transactions with Hezbollah. This also applies to al-Manar's Washington correspondent and any other al-Manar employees working in the United States.

    However the man arrested is not a US citizen, but details never stopped the US from its was against terror or to curry favor with political interest groups. The US has the final say in what foreign companies do also.

    America? Freedom of speech? Hellooo....what is going on here? I'm not personally a fan of Hezbollah, but censoring the free speech that this country was predicated upon is equivalent to the dictatorship we're "supposedly" fighting.

    from what i've read about al manar, it seems like trash and garbage. but i'm not sure if broadcasting trash and garbage to paying customers should be illegal.

  • without getting too political; there are a lot of people out there that don't consider hezbollah a terrorist organization. A good portion of the world would consider them just as "right" in this situation as Israel is.

    But regardless of what you believe, the point is this is really frightening censorship when it comes down to it. Remember when everyone freaked out because google started up in China with filtered searches?? How come its OK for the governemt here to do that with TV stations? That's total bullshit if you ask me. Another fine example of us losing our civil rights in the name of fighting terrorism.
